Timeline

I just mentioned to my SO, the USC that we had to have joint accounts, mortgage, etc.

He says he can't put me on the mortgage because he doesn't have one. He as a building loan until the house is complete, which could be quite a while yet. What am I suppose to do in regards to that? I'm worried that we'll get an rfe, and everything will be held up for an EAD and AP as well.

Will this affect me applying for AOS?

Are you talking about the K1 interview? If so wrong forum... Here it's AOS.

If for the AOS application: coming on a K1 you do not need to provide proof of bonafide marriage with the application only at the interview in which case bills in both your names, joint bank account, being on his health insurance etc are good proofs.

08.2006: Entered with a B-2 visa.

07.06.07: Civil Wedding

07.17.2008 AOS approved with interview. It took 367 Days!

11.08.08: Big family wedding

09.18.09-10.03.09: First trip to France with Hubby

Thanks, I only need to present proof at the interview, that'll give me a little more time.(maybe long time)

I guess the question put more clearly would be, do I have to have a JOINT house loan or mortgage with him for the AOS interview?

I'm just thinking a couple months ahead here.

But chill you have time and there are many ways to prove you have a bonafide marriage when the interview comes.

Right now you need to prove you have an ongoing relationship, that you are often in touch and have met in person ;)

Got lots of proof of ongoing relationship here. I've got everything for the consulate interview. (I hope)

I have to worry about AOS, I have kids I'm leaving behind and would like to see. I'm really interested in seeing how fast people are going to get AP and EAD with the new AOS situation.

Heh. :P I'm always willing to help out. :D

I wouldn't worry too much about the building loan thing but if your fiance can put your name on as much stuff as possible now (utility bills, etc.) that would be good. The reality is that the USC just can't get the foreign spouse's name on everything! It's just not possible for some stuff. I'm only listed as an occupant on the apartment lease because I didn't have an SSN at the time. I do now but in order to "add me" to the lease, the leasing company is going to have to draw up another lease which, well, they probably won't even do.

You could be one of the lucky K1s though that get transferred and approved without an interview. :)

I'm just hoping I'm one of the lucky ones that gets through Montreal this YEAR :wacko:

He said he'd go talk to the bank manager, but he thinks they might have to do up a whole new loan, like your lease. Say's it will be the same as refinancing and it could get really expensive.

We'll just try get my name added on everything we can and hope for the best.

I want to be spoon fed, I want someone to come on and say they did it without a lease or mortgage in both their names :whistle: Feel better now, between the length of time we'll have to the AOS interview and being to get all the rest done, it should be fine. :blush:

It's a loan so I doubt they'd just be able to add you without refinancing the whole thing. Honestly I wouldn't worry about it at this point. Just have a ton of other stuff to bring when your AOS comes around.

Hope you can get through Montreal sometime soon! And thanks for the good luck. Still a few weeks away but still... nervous.

I wouldn't worry about redoing paperwork for this loan thing to get your name on it. Will you be living in the house or will it not even be completed? If you're going to be living elsewhere, you could have your name on an apartment lease or something. While a joint lease is one of the things you can use to help prove your bona fide relationship and comingling of assets, it's not the only thing. Utilitiy bills, credit cards, bank statements, photos, letters or cards sent to you at your US address, his tax returns etc. I certainly wouldn't worry about the loan.
