I have a friend who's stuck and needs help.

She's petitioning for her mother. Her mom has 6 children and she's required to carry all her children's birth certificates to the interview.  One of her child's certificate has a wrong date of birth and it's too late to change. (Interview in 3 days, certificate rectification takes minimum 10 days) the rest are ok. I need advice to pass along. Thank you. She's Kenyan. So Interview in Nairobi Kenya.

Not sure why this error has not been recognised and corrected well before this stage … it may be a difficult sell to the IO that the error got this far .. i hope all the paperwork associated with the application .. the I 130/ DS 260.. all show consistently correct dates . But that aside..

Attend the interview with the certificates she has .. explain the error and how she is addressing it .. Hope that the IO gives her a 221g paper requesting the correct certificate and putting the application under administrative processing until the corrected certificate is provided.

Thank you.  Just to note, this is cr5 case, only the mother is attending interview.  The children are all grown married living there lives and not planning to relocateto the USA. It's just that she had to bring certificates for all of her children. Can an affidavit work?

Additional info. The mother has 6 children. 2nd born is in usa(petitioner). The problem lies with the last born and 2nd to last born. 2nd to last born dob 1981. Last born dob 1983. Last born birth certificate is showing correct dates. 2nd to last born, instead of showing 1981, it reads 1983. So both have same year dob. 2nd to last born location unknown ( over 10 years)

This has nothing to do with whether v or not the children are immigrating. It has to do with the consistency of data    The I 130 and DS260  required the information on all children of v the beneficiary.. whether or not they are usc/immigrating/not immigrating …

My previous advice stands .. i do not think an affidavit will be accepted. It will be up to the IO how this goes. Attend the interview with what is in hand.. explain .. and follow any instructions as a result

That's good advice you've been given right there. The direction to how this case goes lies on what was shared on the I130 and DS260 forms. It won't hurt also to carry some sort of receipt/letter from the registrar to the interview to show that the document change process is ongoing.
