J1 Early Termination to Out of Status to marriage with USC

Hello,

 

Here is my situation:

 

I came to US(Nov 2022) with J1 for Au Pair. I Au Pair'd until September when the orginzation terminated me early for not having a host family. They told me to leave the US as i will be out of status. The thing is, I am in a very serious relationship with my boyfriend of 7 months. We have been speaking about marriage and want to get married within the next 2 months now. 

 

My questions: 

 

Is it ok to be out of status from early termination with J1 visa, and then getting married a couple months of unlawful presence?

 

Any other info or advice would be great.

 

my BF is a US citizen, we have been dating 7 months, marriage is something we want, so i dont want to go back to my home country. No, i dont have  a 2 year requirment or anything.

That is what I have been reading... is it not bad/dangerous to be "out of status" and "terminated from SEVIS"? that would be for a couple months

generally speaking the least day you are out of status the better it is. 

your out of status will be forgiven because you marry USC

Your out of status overstay will be forgiven when your petition to adjust status is approved. Before that happens, you're on "authorized stay" after you file for adjustment of status.  So my advice is to get married as soon as possible and file all forms quickly. You can start learning about what's needed and even filling most parts of the forms before the marriage, so once tou have your marriage certificate you mail it in the next day.

 

From when your J-1 stops being valid and receiving your first communication from USCIS that they have your adjustment of status, you won't have any status so keep that in mind in your day to day life. Interactions with police, even just a traffic stop could have dire consequences, so again I advise you to sign the papers and file asap so you don't have a lot of time between statuses.

I agree with the other responses.  If you are ready for marriage, head to the Justice of the Peace, tie the knot, and get the AOS package in as soon as you can.

Marry and adjust ASAP so you enter in a period of authorized stay. Hopefully it doesn't happen, but this is what could happen if you don't do it quickly
