AOS and name change question

Timeline

I'm filling out the i-130 and it asks if I used any previous names. I had a legal name change a couple of years back.

 

On the i-130 instructions, it states "If either you or the person you are filing for is using a name that is not the same name shown on the relevant documents, you must file your petition with copies of the legal documents reflecting the name change, such as a marriage certificate, adoption decree, or court order."

 

Do I need to provide my legal name change document if all of my relevant documents (passport, ID, paystubs etc) matching my current legal name?

If “AOS” in your topic’s title refers to I-485, there is a possibility you will be asked for US citizenship evidence that supports your claim to a U.S. passport. If so, and if that evidence uses your  prior name, your lawful change of name document will be required.
 

If this will be consular processing, it is even more rare, but the beneficiary might be required to show your  US citizenship evidence that supports your claim to a U.S. passport.


 

Also, rarest of all is an I-130 interview of and/or biometrics collection from the petitioner. If so, expect to show your  US citizenship evidence that supports your claim to a U.S. passport.


So you are good for now, but you need to your documents ready for what might come.

But my passport is in my current legal name. Will they ask if evidence that I am really a US Citizen?

yes but not relevant to the three scenarios I listed.

They asked me.

 

Seems to happen to 0.1 to 1 percent of I-485 cases. USCIS has an absolute right to see that evidence.

Ah alright. So do you think I can just leave it out for now, and then IF they ask, I can submit the legal document?

If it was me - I would avoid delay / RFE by supplying as much evidence as possible rather than the "wait and see" approach. 

 

With an increase in approvals after waiving interviews etc- you stand a better chance supplying too much evidence.

Hmm I guess I'm just curious - if all my documents are in my current name, why would it matter? Passport is proof of citizenship right?

By this time you could have submitted I-130.


I’ve contributed all I can, and I don’t wish to argue or bicker, so I won’t post more in this thread.

There is a reason they ask you on the form, to disclose all names you have used.

 

Supplying evidence of those names is a natural progression.

 

Why are you loathe to do so ?

Your birth certificate is proof of citizenship. I assume the name on that document is not the name on your passport ?

So I guess I should submit my naturalization certificate, legal name change all together when I file?
