Hi guys!

 

I'm wondering if any of you would know much about the household size and income requirement in regards to your kids. The petitioner has 4 children but only 1 of them resides with them full time. The other 3 they have 50/50 custody so they don't live with them full-time. When determining household size to know income requirements for I-134, would they only include the 1 full-time living child, or all 4 of them? 

 

Side note: In terms of taxes, the petitioner claims only 2 of their children on their taxes. Their ex claims the other 2. In case this goes off taxes instead.

When it comes to minor children, all are counted in the household size regardless of where they live or whether or not they’re claimed on taxes.

I have a follow-up question for this haha.

 

With having co-sponsor, they don’t get included in the household amount if they don’t live with them, correct?

 

Also, with co-sponsors it becomes a combination of both theirs and the petitions income?

The question is not clear. I assume “they” means children. Whose children? The beneficiary’s children or the joint sponsors children?

No, there is no combining. Joint sponsors must qualify on their own which means their income must meet the financial requirements.

 


I think there is confusion on requirements for the joint sponsor. The requirements are exactly the same as if they were the main or only sponsor. Which means if they have children, just like a main petitioner, they are included in the household size regardless of who they live with, along with anybody else they claim on taxes plus the intending immigrant.
