The family reunification parole FBP / 134a clarification ....

Hello,

Our goal: We want to petition for my wife's Colombian sister ( not married over the age of 18 ) and daughter ( under the age of 18 ) under 134a / FBT ( faster :)!!  )

I have questions/clarification regarding 134a FBP ( July 2023 update ).

  1. "The NVC will email the invitation to petitioners" <-- To obtain a invitation we would need to start the I-130? ( we have not )
  2. "Invitations will be sent on a rolling basis based on operational capacity, the expected period of time until the principal beneficiary’s immigrant visa becomes available, and in a consistent manner to ensure process integrity." <-- Because we have not started the I-130 ... did we miss the boat for the FBT? or do we still have a chance?
  3. Because my wife doesn't pay taxes via W2 but we file taxes jointly ( I work and obtain a W2) ... can she use my W2 / paystubs or would I need to "sign a separate form as a joint sponsor to meet the financial requirements."  when filing the I-130?
  4. Could I petition for my sister in-law and bypass the extra paperwork ( joint sponsor) ? ( My assumption is no because uscis doesn't consider a in-law as immediate family? )

note: the quotes are from the uscis web site.

Details ....

I'm a US Citizen ( Husband ) who is married to a US citizen ( my wife ) who obtain US citizenship by starting with the K1 ( Me as the petitioner ) up to and completed the N-400.

My wife was only a Colombian citizen when we started the K1.

Currently she is a house wife / halftime student, I work full time and we file our taxes jointly.

We want to petition for her Colombian sister ( not married over the age of 18 ) and daughter ( under the age of 18 ).

Thank you!!!!

Your wife needs to file I-130

You have not missed the boat yet. If a different party takes the white house in 2025, and she has not filed I-130, it is over for sure

I-864 will not be required from you for decades.

There is a Court case about the whole HP programme, I have yet to see any invitations issued and it is unclear as to who they will be sent to so please let us know if you get one.

For whatever reason they seem to want to keep quiet about it.

To my knowledge no one has received an invitation, I have searched a few times and can find no mention on the Internet of any being issued so a bit premature.

I may be out of touch here, but how does OP SIL qualify for I-134A being that she's Colombian?

Immigration journey is not: fast, for the faint at heart, easy, cheap, for the impatient nor right away. If more than 50% of this applies to you, best get off the bus.

One of those weird Biden announcements, very unclear but essentially I think it covers 4 countries including Colombia and some people waiting for an Immigrant Visa will be invited to come and hang out.

How they select, how many people they select all unknown.

I would be fascinated to find out why.

Supposed to have started 2 months ago but who knows?

bullet 3 from the following link:

https://www.uscis.gov/i-134a

Colombian, Cuban, Salvadoran, Guatemalan, Haitian or Honduran, or their immediate family member as part of the family reunification parole processes. Only individuals who received an invitation specifically inviting them to request to be a supporter and initiate the FRP process by filing Form I-134A may file.

I figured. I was out of loop with Colombian addition

It was announced months ago , but start date was July 31. 2023..so it’s still early

OP will have a bit of waiting to get the invitation …assuming program lasts..as @Mike E points out.

https://www.uscis.gov/newsroom/alerts/invitations-to-be-issued-for-family-reunification-parole-process

The Department of State’s National Visa Center (NVC) will begin issuing invitations under the family reunification parole (FRP) processes for Colombia, El Salvador, Guatemala, and Honduras on July 31, 2023.

The wait will be forever if the potential petitioner never files.

Whereas if the petitioner files, and if the election results in a change of party, I envision 100s of thousands of invitations by December 1, 2024, with the idea that the next President will be unable to shut the program down just as the previous president was unable to shut down DACA.

As America’s greatest immigrant ever once said: “you miss 100 percent of the shots you do not take.”

Interesting take . I don’t think there will

be issues if when program gets done away with.
It mirrored the V-Visa they  had in 2000 when they took away 245 (i).
A bit of honey to get the bitter medicine down . ..only now it was the Bidens tough EWI consequences and asylum floodgate closure.
