Hello All,

   I'm putting together everything to sponsor my wife/child.  We're still unsure of Spousal or U4U, although probably U4U.

   I'm wondering about my background check.  My understanding is the only real disqualifiers are those involving others(kidnapping, human trafficking, sex crimes).  Unfortunately, I do have a spotted record.  I have 2 crimes on my record.  First is false statement on firearms application and the other is a drug possession with intent(anxiety meds I had without script).  The first was <12 years ago and the other nearly 5.

   Do these rise to the level of disqualification?  I'm a good person, well educated, good home and family, just made mistakes.

   I understand it's a case by case basis?  However if I need a Co-sponser better I know now.

PS: Please don't think less of me or that I'm a criminal type.  Just a good person made bad decisions during times of mental health crisis(Documented health issue)

Just include the offenses  and mental health record  (with court dispostions of record(s)  and treatment(s) for mental health )

 

your offenses are in the past and not ones that mean disqualification

 

U4U  could be faster but at this time it says the following 

The temporary Uniting for Ukraine program, sometimes called U4U, offers a two-year stay in the U.S., given that individuals or families find someone, or an organization, to financially sponsor their stay. After that two years, the Ukrainians' pathway to citizenship is unclear, if attainable at all.Jan 20, 2023

 

But  to add "i can't see either democrats or republicans not offering citizenship later on as  they are not here illegally"  my 2 cents

   This is great advice.  I hadn't thought to include my medical info along with the offence.  I believe that will make a huge difference.  Everything is well documented, including mental health treatment.

   Regarding the 2 year stay; it's my understanding we can apply for change of status during this time.  Although, as you said, don't see either side actually deporting anyone.

   Thanks Again.  This has been eating at me and it's great to get a little hope.

your issues are in the past

u fixed them

leave them in the past 

only report them to immigration as they have to know it all like a sibling who keeps reminding us daily of our errors

 

and embassy may ask the new wife if she knows

Unless you are asked, there is no need to mention or deal in any way with your criminal record, unless it includes a sex crime against a child.  Yes, your record will be checked, but you don't need to deal with it.

 

If your spouse and her children are in the USA legally, they have a path to a green card and later citizenship through that marriage.

Facts are cheap...knowing how to use them is precious...

   This was my first thought but messages got me thinking.  Your opinion best to just leave it alone instead of trying to get ahead of it?

   It's embarrassing, my wife is fully aware.  Nothing was an ongoing criminal business, just stupid mistakes.  I guess maybe since not crimes involving anything prohibited it'll maybe fly through.. hopefully?

Yes, just leave it alone.  Nothing relevant to get ahead of.
