Hi everyone 

A little background on my previous question. Our I-130 petition got approved june and from the letter we got uscis requested we file I-1824 in order for them to send our petition to nvc. They stated we indicted both adjustment of status and consular processing on our I-130. Looking carefully into the form we submitted we didn't see any where we indicted that. I attached a screenshot of our form. We tried to reach uscis live agent for weeks but we got through last week and the agent said it was because on what was written on 46a. I have attached that for you guys to see. Finally my wife a usc spoke to a lawyer today and he said it wasn't our mistake that it is from uscis. Please i need your advice on what to do. We have waited for a year to get our petition approved and we can wait fir another year to fix this.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

Timeline

It appears the I-130 contained some ambiguous information which led USCIS to question whether this was an Adjustment of Status case or a Consular Processing case.  I suggest you submit the I-824 as directed by USCIS.  Your attorney should know that, imo.

Clearly a USCIS mistake as 61 was left blank and 62 correctly marked for consulate 

 

Have USC contact her congressman for help

Odd that the rep focused in on that item that is not important.  Doesn't make sense for them to do that.

Seems very common both to make a mistake and for it to be used. Maybe the increase is due to filing online?

They have had glitches  both paper and online . Came out in omnbudsman report a few times …but assuming OP s copy is accurate as filed ..this is just a human USCIS ( data entry point )error
