F1-Reinstatement denial( entry ban?)

Hello members, this is asghar from pakistan. I stayed in usa for a period of 6 years on f1 visa. But unfortunately some how i had lost my status. I tried to fix by taking admission into a new college. They issues me a new i-20. I had used that new i-20 and left usa and then returned but some how at the port of entry they inserted previous i-20 number into the system. Long story short i had to apply for reinstatement which was denied. They said i need to leave the country as soon as possible. I left the country after receiving denial notice from uscis. My both kids were born U.S. citizens. I had to burn my American dream. Now i am back from where I had started my journey. 6 years of my life seems wasted. I am glad that at-least kids got the citizenship but I wasn’t able to get work experience in usa. Is there any lawyer who is reading this can help me to find out if i am banned from usa or not. I would really appreciate your help.

October 17, 2019 AOS receipt date 

December 09, 2019: Biometric appointment

January 15, 2020 RFE received

January 30, 2020  RFE response sent

Feb 7: EAD approved and interview scheduled

March 18, 2020 Interview cancelled

April 14th 2020: RFE received

April 29, 2020 Approved without interview

May 1, 2020 Card in hand

 

REMOVAL OF CONDITIONS

February 1, 2022 package sent

March 28, 2022 Fingerprints reused

July 18, 2023 approval

July 20, 2023 Card in hand

 

N400 

January 30,2023: Online filing

February 4th, 2023: Biometric appointment

June 15th, 2023: Case actively being reviewed

July 11th, 2023: Interview scheduled.

August 30th, 2023: Interview!

August 31st, 2023: Oath ceremony scheduled.

Sept 19th, 2023: Officially a US citizen!

You do not have a ban..but do have a few problems.

 

Visitor visa will be denied ( due to 2 USC kids)

 

Any other non immigrant visa ( let’s say work ) would have to be dual intent to clear the USC kids hurdle .

 

Many switch schools and get past CBP without problems .
 

Does your denial letter give you date of termination of status ..as the date 1st I-20 was pulled or later date of reinstatement denial ? 
 

If you can redact name /personal info , upload the denial letter .
 

There a few very savvy posters that have tackled F-1 issues ..here’s hoping they see your post.
 

Are there details in denial for periods of time they state you failed to maintain status ? How many days? 
 

Did school # 1 refuse to help you reinstate ? I always thought they are helpful .. and did school # 2 help you w reinstatement application?

Different visa's have different requirements and the only way of making a sensible comment would be in connection with the specific basis.

 

It does not appear you have a ban but that call would be down to the CO. If you did overstay by more than 6 months you have a 3 year ban, a year is a 10 year ban.
