Hello Everyone.

 

I am new here. Was referred by someone that had gone through the k1 process.

 

I am very frustrated at the moment. I just got the update that the case and it was denied.

 

I am not sure why yet. Still waiting for the paper to show up that tells me. I don't understand why they just can't give me an explanation when I sign into the account at uscis. Why do I have to wait for snail-mail.

 

Can anyone confirm this for me. A coworker said, sometimes a deny is a soft deny. Meaning they require something further. Is this true or once it says denied, that's it?

 

Also, I've read on the internet two different things. One thing says I can appeal it, the other says I cannot. Which it true?

From what I’m reading I’m assuming you mean your I-129f petition was denied. Please confirm. 
 

Did you fulfill the in person meeting requirement before filing the I-129f?

Exactly what told it was denied?

"The US immigration process requires a great deal of knowledge, planning, time, patience, and a significant amount of money.  It is quite a journey!"

Senior Master Sergeant, US Air Force- Retired (after 20+ years)- Missile Systems Maintenance & Titan 2 ICBM Launch Crew Duty (200+ Alert tours)

Registered Nurse- Retired- I practiced in the areas of Labor & Delivery, Home Health, Adolescent Psych, & Adult Psych.

IT Professional- Retired- Web Site Design, Hardware Maintenance, Compound Pharmacy Software Trainer, On-site go live support, Database Manager, App Designer.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

A soft deny would be a NOID, Notice Of Intent to Deny.  But it sounds like that you are saying your case status at the USCIS case status page clearly says "Denied".

 

If this assumption is true, then its a hard deny. You have something so severe that you are not eligible for the K-1, you can not appeal it.

 

Did you not meet the 2 year meeting requirement?

Are you or her not already have final divorce decrees from previous marriage?

Are you not a USC?

Do you have a criminal history against children?

We started talking Nov 22, 2021. Filed the case, but because of covid, I could not fly to meet her. But did go meet her and spent 1 week with her and her mother in March of this year.

Looks like a hard denial.  Please let us know what the denial letter says (if you get one).
