Hi All! Quick question. My husband is looking to file for his younger brother (12 years old) to move to the US and live with us. I'd love to learn more about this specific Visa and processing time. His brother would be immigrating from Jamaica. Much appreciated!

Annual F4 visa issuance is limited by law and the queue of applicants waiting is way higher than the quota, meaning it is currently around a 15-year wait - visas are currently available to those whose cases were filed by March 2007. This wait could well get longer looking ahead as the queue seems to generally grow over time, but the quota does not.

This is the type of thing you file without planning (like to live with us)and forget for at least a decade. By the time he is able to apply for his visa, he will be almost a 30 year old man may be with a wife/gf and multiple kids. Brotherly bond may change or sister-in-laws may not like each other at all. Sponsorship requirement could go from 1 to 5. So just have your husband file for it now, set a timer for 13 years, and forget about it till then.

What if my Husband files for his mom and since his brother is a minor could he come over with her and do a joint Visa request/interview?

Nope, because a parent visa is an immediate relative and no derivatives are allowed on that. She could get her own green card and then file for him herself (as a minor child of an LPR) which would be faster than a sibling visa, but the entire process would still likely take 4-5 years to do it this way.

Your husband has to be a US Citizen first.  Then he can file.

Good Morning Visa Journey Community! 

 

I have a quick question. My husband and I are planning to file for his parents to immigrate to the US. Which is a pretty straight forward process. He has a younger brother and sister who both live with his parents in Jamaica and their ages are 12 and 16. The timeline for parents to immigrate is pretty short in most cases but for siblings the wait is quite excessive. If we file for everyone at the same time will that speed up the process for siblings since they are under 18? 

 

Any insight would be greatly appreciated.

No as available green cards for each category are numerically limited by law. Ages do not matter in this case. F4 (siblings) cannot be issued visas under any circumstances even if it’s life or death if their visa number is not yet available (PD is not current).

I suppose it is the younger one that may be the issue, maybe wait a few years before filing?
