I know its getting near the deadline, but I just need to clarify which forms I need. My wife is USC (didnt not earn anything overseas but lived overseas with me until June) and Me the greencard holder (lived and earned overseas until June) who has worked here (in the US) since August.

I need 1040EZ (filing jointly) 2555(EZ or not?) and a signed letter saying 'Treat me as a USC for tax'?

Not sure what country you're from, or if that makes a difference when filing, but we sent off:

1040 Married filing jointly

2555 for both, as both of us lived and worked in Ireland

Statement declaring my wish to be treated as a U.S permanent resident for tax purposes.

And we received a very healthy cheque into our bank for our efforts ;)

03.04.2009......Posted I-130 to U.S. Embassy

03.04.2009......Ordered Police Certificate for Visa Purposes from Local Garda Office (ordered over the phone)

03.05.2009......I-130 received at Embassy

03.06.2009......Received Police Cert

03.18.2009......I-130 Approved

09.10.2009......Medical Exam

09.23.2009......Embassy receives Notice of Readiness

10.13.2009......Received our interview date

10.29.2009......Successful interview!

11.5.2009........Visa received in post

11.7.2009........All the family flew to the US together :)

12.20.2009......Received Welcome to America letter

12.24.2009......10 year Greencard received in the mail

Mmmm, let me check real quick....here we go...Form 2555 for both of us. I think 2555 is just a shorter version of 2555-EZ? But we had no issues or problems at all! :)

seriously - find GIMYGIRL's post where she spells it out STEP BY STEP> I literally followed those EXAT instructions...and had no problems! :)

Wait...let me get this straight...even though I didn't live in the US at ALL during 2005 I still get taxed on income I had in Canada? #######? I wasn't even a greencard holder in 2005! I got my greencard in March 2006. So does my husband file based on my CURRENT status, or my status during the 2005 tax year? Becuase if the latter is the case, then I file as a non-resident alien spouse, but if the former is true, then I have to be filed as a resident alien spouse....and claim my $3000 school scholarship. How they can tax my scholarship is beyond me, when I already have to pay fricken taxes on it in Canada!!
