Finance is divorced and is currently changing name

Hello,

 

I am a US citizen  and my fiancé is german and  are filling out the forms for the k1 visa, she awas previously married and is currently changing her last name back to the maiden name, i know we must wait till that's complete to submit everything. my question is do we also need to submit the previous documents showing she changed her maiden name before in the previous marriage? we have the divorce certificate already.

I-129F is filed with USCIS. If approved, you then move onto the Department of State to get a K-1 visa. That requires DS-160.

All name changes should be documented

Not sure how name change in Germany works. In many countries, the divorce decree is evidence of name change. 

If this is not the case for Germany: 

If you are submitting the I-129F and the divorce is final I would go ahead with submitting I-129F now. You can apply for her in her old name and update to her new name at DS160 stage. Don't delay because you do not have official documents in her name. 

If you mean she hasn't changed her name on documentation but she has changed her name already - then she can use either her old name or her new name.

If the divorce isn't final. Then you will have to wait for the divorce to be final before you can submit the I-129F.

so in germany the Divorce decree says her previous marriages last name not her maiden. for her to change it back to the maiden she has to do some paper work which she is getting together now, what i want to know is on the I-129F should i not put her maiden name as her primary name or do i put what is currently her name? (see screenshot).

I would just put her current legal name. You can update her name when she has to file the DS160. K1 is speeding up but it is still taking about 1 year now for the first stage. SO, I wouldn’t delay filing for this reason.

Once case moves to the consulate, she will need to show the consulate originals of every lawful change of name document. Her current legal name at the time of her interview will need to match the name on her passport.

 

And the same will be true when she files I-485.

 

She will need originals for I-485 too.

ok so basically put her current legal name under beneficiary and maiden under other names used. then once this is approved then for the ds160 as @Redro says we change it with the proper documents attached?

yea we know the wait times still are taking awhile thats why we want to file now.
