Someone explain me the american justice system!

Ok, let me explain why I started this topic.

Two of our family members (hubbies side) got arrested in 2005 for a crime that was commited 2004. They got charged with aggrevated sexual assault, the bond was $100000.

For the same crime, two other guys got arrested in 2004 already, just days after the crime was commited. They got off for $40000.

I know this will probably rise some more questions, but I don't want to get too much into details, I hope, that is understandable, since it starts to be all over in the media already.

The police do not around arbitrarily arresting people. It is only done by way of a warrant issued by the court after probable cause has been established. This requires sworn testimony and an affadavit.

Or requires a bill of true indictment issued by a Grand Jury upon hearing sworn testimony.

So based upon what you have posted, it makes no sense. Why was the warrant issued???

That's what I want to know too!

Maybe some more info. It all happened at a after-prom-party in a hotelroom. The older one of the two brothers rented the room, that's how his name got into play, but he had a separate court appearance for that. The other brother came into play because he was listed at one of the guys at the party (his own prom).

Interesting was, that the first two guys (trhe ones that the victim identified) were arrested only a few days later, the two brothers over a year later!

Believe me, we hve a lot of questions!!
