I hope there are more answer to this. I just don't know too much for sure but I'm sure it's ok if the job's HQ/main address is in the US for WFH. I'd follow along because my Husband may be interested to WFH with jobs not from the US for future reference until he Naturalize.

I do see you do have some good ties to the US, filing taxes and having your money in the US bank, managing your expenses and living arrangement here. Those are the good checklist.

I decided to ask ChatGPT, but got no idea where the source is from. It says the internal knowledge is up til then "Sept 2021" and couldn't share link. So it tells a little bit, just not enough. I sent a suggestion through the USCIS's Feedback if they can help provide the missing info but I doubt that'll come in anytime soon.

I think you may have the clear sky because we're not talking about being a sponsor for someone as there are some exclusion vs a Permanent Resident working. Interesting for sure!

If they physically live in the US how would that create a problem? They are working (remotely) in the US, no?

By the end of the year, I will have spent at most a week or two in the country where the company was established. I'm not renting anything there, and my only connection is the company itself. I believe it will be abundantly clear that my ties to the US are stronger.

At the risk of digression, imagine if the U.S. and a foreign country each had an effective rate tax of 51 percent on your income. If you could not claim the foreign tax credit, and earned say $1000, 1000 - 510 = $490, and you would owe $510 to the IRS, leaving a hole of $20. Absurd.

 

Despite being  US resident, I claim a foreign income tax credit on most of my domestic mutual funds, because a portion of their income is taxed in other countries, because most large cap U.S. companies have foreign operations.    When they pay dividends, they report foreign income paid on their profits.

I went to Ask Emma and it connected me to a live rep. The live rep said employment are not determined. I asked if there would be any other condition, the live rep said no.

That's true, though I ran some theads from VJ, and ChatGPT gave utterly wrong answers. I guess EMMA agents were even worse.
