Hello,
I am looking for some immigration advice and wanted to schedule some time with an attorney.
i had a few questions around legal coverage and initial questions -
- My case - I currently have an H1-B visa and work at a FAANG (big tech). My wife is considering switching from an H1-B visa to G4 visa to work for the United Nations. From initial assessment , it seems like I need to switch from H1-B visa to G4 as well. My questions are around implications of the switch , including the below -
- Do I need to switch from H1-B to G4 visa or is there any provision where I can retain my H1 visa?
- I currently have a green card priority date of 2015. If I switch to H1-B visa, will I still be eligible for a green card when my priority date becomes current. If yes, then can both of us switch to a GC?
- Are there any tax implications of my taxation as an H1-B holder vs G4 visa holder?  we currently file for tax as joint filing today
- For my wife (we are Indian citizens), what is the process and estimated timeline to switch from G4 visa to GC?
Thanks

Following for info.

I also have questions, why do you think you need to leave your H-1B status? Your status is not dependent on your spouse's employment, so I do not think that you would need to move to a G4 dependent status, and cannot find anything that states otherwise but would be curious to see what an attorney would say.

What was the basis for your i140? EB2? PERM?

It could be straightforward but there seems to be a few moving parts with the H-1B, i140 and a G1/G4.

Thanks, that's a good learning point. I'm not familiar with G visas so wasn't able to find the relevant info, but looks like you have your answer. As for your PD for your i140, let us know what your counsel advises you of. These are rare cases and from others I've seen online, no one comes back to update on how it proceeds.

good luck!
