i read about CSPA so i sent an inquiry if he is qualified. The response i got is they escalated it and now the F24 in CEAC website is now F22. We can now also able to put info in it such as affidavit of support and sponsor. 
 

his case is not current but how come we are able to navigate the CEAC? 
 

i tried using online cspa calculator but it says age is less than 21 but ineligible for visa? 

if ever he gets interview, is his age frozen at 18 yrs 2 months 15 days?

he is now 23 yrs old. so couple of yrs ago before he was 21 yrs old, we were already uploading documents in CEAC. We submitted D 260, paid IV fees (january 2021) , AOS fees (June 2020), submitted all the civil documents. then we got a message (April 2021) that my mother does not have a US domicile, she needs co sponsor. as I was gathering these documents, suddenly we can't upload anything in the CEAC website. I still sent the documents to NVC they need via mail since I could not upload them. the visa class was changed from f22 to f24. from what I understand that time, he was over 21 yrs old, aged out already and NVC automatically put him f2b. there was also was a message in CEAC that due to numerical limitations that a visa is not available at this time.... from time to time I would check CEAC and still can't do anything / upload. I sent an inquiry 1 month ago to NVC to ask if they received the documents I sent via snail mail. NVC replied to the petitioner email and we got a message in CEAC :  

 

To Whom it Concerns: We reviewed your petition and we determined that the applicant appears to be eligible for the Child Status Protection Act CSPA benefit. Please note that our determination is not final. A consular officer makes the final determination at the applicant's interview. If you think we made a mistake, please notify us on our Public Inquiry form at https://nvc.state.gov/inquiry.

 

also in the message, they asked for my mom ITR, co sponsor i864 forms and ITR, US domicile. his visa class is now f22. we just submitted all the documents they asked.

 

the NVC response did not specifically mentioned he is back to f2a. which PD I should i look at now? if it is f2A, will he benefit from CSPA if his case becomes current? he might be 24 or older by that time (just a guess)

I think he aged out.

 

D = approval date minus PD is < 2 years

 

He is over 23 now. 
 

23 - D > 21.

Im also confused because I remembered paying the IV and AOS fees like about 1-2 wks apart. But when I looked up the receipt, IV fees was rejected on May 2020 but accepted January 2021. It took them 8 months to process a payment? Which fee supposed to be paid first? 
 

also, is it possible that your PD can be current more than once?

I now am not so sure he aged put given he did seek to acquire a visa before he was 21 (even without the CSPA bonus, he was under 21) while his category was current.
 

While it did retrogress while NVC and the embassy sat on his visa application doing god knows what, my interpretation of what https://www.palacioslawfirm.com/practical-guide-child-status-protection-act-cspa-part-3/ is that he should not age out.

can i ask nvc to switch me back to f2b?

 

i was originally f2a then switched to f2b then back again to f2a

 

i was reading articles, google, forums and it looks like i really aged out. but i am not an expert either. I dont want to lose hope but at the same time I dont want to lose time, effort and money and get refused visa after everything. my mom works minimum wage and i don't want to waste it. i read in an f2a fb group that some over aged applicants still got refused visa even nvc said they still be eligible.

As a general rule I would roll with it an see, F2b is a long wait.
