hello, 

 

just a quick back ground, im a USC. I petitioned my mother. my mother is LPR  who petitioned my unmarried brother who is over 21 yrs old. his PD is 2018. my mother is not sure if she really wants to live permanently in the USA due to her medical conditions. is it possible if I will apply sibling petition at the same time? I know it will take decades but there is no other route my brother can come here if my mom's petition fall off.

To naturalise, sounds she has been a LPR for 5 years but may not meet the time in the US requirement, but if she does not want to anyway moot.

My mother petitioned my brother. She submitted documents, paid fees, i co sponsored. These were all done 2 yrs ago. The CEAC website says IV status complete. It doesn’t say anything about the documents we submitted. I sent inquiry to the NVC but no response yet. 
 

DOB: 3/1/2018 

PD: 5/30/2018

approval date: 3/24/2020

Yes she wont qualify. That is why i am not even sure if she will stay here longer until my brother’s petition go through. His case is already at nvc. We paid the fees and submitted affidavit of support. It has been 2 yrs and no update after that.  We filed petition in 2018

Are you thinking he is F2a? I had assumed F2b.

I see. I thought once the case is in nvc and its complete they send your papers to the embassy and will do the interview. 

NVC is the storehouse of petitions not the consulate.  Once they have an available interview slot for that class of petition they will let you know

From your other post, your mother is still an LPR.  If your brother was born in 2018, then his visa category is F2A.  Unfortunately, his case PD is no longer current on Table A of the Aug 2023 visa bulletin.  F2A (Philippines) PD retrogressed to 08 Oct 2017 -- https://travel.state.gov/content/travel/en/legal/visa-law0/visa-bulletin/2023/visa-bulletin-for-august-2023.html

 

Until his PD becomes current again on Table A, he will not be in line for visa interview, even if his case is already documentarily qualified (DQ) at NVC.
