Russian IR1/CR1 -- State of the situation: Warsaw vs. Jerusalem? Or something else?

Almost nothing in the entire legal-immigration process has anything to do with common sense.  :P 

06-04-2007 = TSC stamps postal return-receipt for I-129f.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

That was exactly my point... rhetorical question. It's not. So therefore, I'm wary my spouse getting another residence card even if it makes sense in terms of embassies for the interview, same reason I think she should get a police certificate for Georgia.

It doesn't hurt to overprepare. Might as well get the certificate just in case, assuming it's not too much of a hassle.

It’s not much hassle, but then I wonder if they’ll ask extra questions. Like, why did you submit this if you’re not a resident? Did you change your address without telling us? Etc.

Just bring it along and present it only if asked.  I think that the suggestion was along the lines of "bring everything possible so that you have it, just in case, to preclude being sent away because you didn't bring something that they wanted."

I was under the impression you had to upload these documents before the interview.

No problem with the beneficiary changing addresses prior to the interview.  It would be a problem to not list an address where the beneficiary actually lived and worked.  Just make sure to update the DS-260 address info.  That can be done at the consulate on the day of the interview at the pre-processing steps, prior to the actual interview with the CO.

Any idea if someone gains a residency in a different country while waiting for NOA2 if anything needs to be done?

Just list the address in the DS-260 and get the appropriate police certificate for that country.  With proof of legal residence, the applicant has the option (but not required) to request for visa case transfer to the consulate in their new country of residence.

Please correct me if I'm wrong, but there's no burden on the applicant to provide proof of their intention to immigrate to the U.S. On the contrary, immigration law assumes that a visitor plans to stay (which is why for non-immigrant visas you have to prove that you are planning to leave). There's enough common sense in that to be not worried that your spouse's newly-acquired residency in Georgia is going to cast any doubt on her intention to immigrate to the U.S.

 

The petitioner, on the other hand, does have to prove that they have domicile in the U.S., and if they are not currently living in the U.S. that they have intention of moving there, establishing domicile, etc. That's an important part of the NVC stage of the process.

Hi all,

 

My wife are starting the CR-1 process and curious if anyone knows if it's possible to go through any consulates in Asia (Thailand, China, etc)? She currently lives in far eastern Russia so these options would be much easier geographically. I've emailed the US embassies there and can provide updates, but was curious if anyone else has already looked into or gone this route?

Welcome to the forum!

 

You need a consulate where the personnel are familiar with Russian documents, their format, and the language.  An idea some months ago was Mongolia, but it has a tiny consulate (2 officers maximum, more likely 1), and probable unfamiliarity with the documents.  You're pretty much stuck with the locales mentioned in this thread and elsewhere -- certain places in Eastern Europe/West Asia and, fortunately, Jerusalem.  You're free to write to other consulates, but gaining an exception would be nothing short of a miracle.  Anyway, if you're just starting the CR-1 process, there's all kinds of time for current political conditions to resolve, so avoid worrying now.
