Hi,

hope someone can give suggestion:

my brother is planning to sponsor his Cambodian fiancée to USA. He’s a US citizens. His fiancée has a 5yrs old daughter with her ex-bf whom she has full custody. If he sponsor his fiancée and passed the interview, will her daughter come along too? Or he needs to file something else? Thank you.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

He speak very little English that's why I asked on behalf of him.  Thank you for the link.  Basically he also need to file K-2 along with I-129F.

He will file one I-129f (child doesn’t need a separate petition, just list them in an appropriate section). Down the line, once the petition is approved and gets to the consulate, he will fill out & pay two DS-160 (one for fiancé one for child) and pay for two medicals.

Do my brother's fiancee need any documents besides the daughter birth certificate? Does she needs full custody certificate, and consent statement from her ex-bf to have the daughter come live in USA? The daughter live with her since birth and no connection with the dad since now they live in different city.  Thanks!

She will need a document from the court that confirms she has full custody or permission to take the child out of the country permanently.

Timeline

My brother fiancee's judge statement stated that she married but was not legally married, no marriage certificate nor license.   Also,   judge issued another certificate that her marital status is Single.

On I-129F question #34 page 6,  asked, "Has your beneficiary ever been previously married?"

Since she had a wedding ceremony and afterward they never went to the judge to get marriage license or marriage certificate.  How should this be answered?
