Special counsel Jack Smith resigns from DOJ as Trump’s fight to block final report continues

Special Counsel Jack Smith resigned from the Department of Justice on Friday after he completed his two criminal investigations of President-elect Donald Trump.

The departure was disclosed in a court filing submitted Saturday to Trump-appointed U.S. District Judge Aileen Cannon of Florida. “The Special Counsel completed his work and submitted his final confidential report on January 7, 2025, and separated from the Department on January 10,” the filing reads.

Jack Smith's Final Stunt

 

In a footnote contained in a motion last week, the Department of Justice disclosed that Special Counsel Jack Smith officially resigned on January 10.  Smith had announced his plans to leave the DOJ a few days after Donald Trump won the presidential election.


But it appears Smith, the losingest prosecutor in DOJ history, pulled one more stunt on his way out the door: sending an unnecessary and one-sided "report" on his two failed prosecutions of the incoming president to Attorney General Merrick Garland.  [...]

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

Jack Smith, the prosecutor who would never admit what he was doing

 

[...] In retrospect, one aspect of Smith's prosecution stands out. The single guiding fact of his prosecution — that he was working to indict, try, convict, and jail Trump before the 2024 election — was something he could never, ever admit.  Justice Department guidelines unambiguously forbid such political moves: "Federal prosecutors and agents may never select the timing of any action, including investigative steps, criminal charges, or statements, for the purpose of affecting any election, or for the purpose of giving an advantage or disadvantage to any candidate or political party."

 

That is exactly what Smith was doing.  Many Democrats, including President Joe Biden himself, were angry that Smith and Attorney General Merrick Garland, who appointed Smith on Nov. 18, 2022, got a slow start in the Trump prosecution.  Smith indicted Trump on Aug. 1, 2023, and by the end of the year, the prosecutor was racing to get the former president into a courtroom.  But Smith would never say why he was in such a hurry.  [...]
