The Trump sentencing:  Curtain to fall on Merchan's Hamlet on the Hudson

 

At 9:30 a.m. on Jan. 10, 2025, the curtain will fall on the longest performance of "Hamlet" in history.  Acting Justice Juan Merchan will finally decide whether "to be or not to be" the judge to sentence Trump to jail.  (Spoiler alert:  He appears set to avoid a jail sentence and likely reversal.)


Since Trump's conviction in May 2024, Merchan has contemplated his sentencing options.  This was to be the orange-jump-suit moment many longed for over years of unrequited lawfare.  They will likely be disappointed.  As some of us noted after the verdict, this type of case would often result in an unconditional discharge or a sentence without jail time.  That prediction became more likely after Trump was reelected in November.  Limits on Trump's freedom or liberty would likely result in a fast reversal, and Merchan knew it.  [...]

Trump sentencing:  A BS conclusion to a BS case

 

[...] So, what happens on Friday?  In his decision rejecting Trump's argument, Merchan laid out some of his thoughts.  He said it was not his "inclination" to sentence Trump to jail, even though he has the authority to do so.  The problem with prison time, Merchan said, was that prosecutors "no longer view [it] as a practicable recommendation."


Instead, Merchan said a sentence of "unconditional discharge" seems to be the "most viable solution" to "ensure finality" of the case.  That would mean that the case would be over, Trump would be an officially convicted felon — good for those Democratic sound bites — and Trump could also begin appealing the verdict, as he has been itching to do.


The question now is whether Merchan will do what he says.  "We only have Merchan's word for it that he will impose [unconditional discharge] on Friday — he could always change his mind," University of California, Berkeley, law professor John Yoo told me in an email exchange.

Cruel:  Trump Sentenced To Drink Only Diet Pepsi

 

NEW YORK, NY — In a controversial conclusion to the "hush money" trial against him, President-elect Donald Trump was forced to appear in court electronically as presiding Judge Juan Merchan cruelly sentenced him to drink only Diet Pepsi from now on.


The shocking sentence was handed down this morning in a New York courtroom, with audible gasps being heard from the gallery when Judge Merchan informed Trump of his punishment.  The president-elect defiantly voiced his opposition to the sentence immediately afterward.
