To be fair, this one’s not on Jack Smith, it’s on Merrick Garland for trying to find a hack to do his dirty work without having it blow back on him. Only he looks to have messed that up anyway.

I am curious if the Loper decision impacts this.  SCOTUS seemed to indicate Congress needs to perform its duties.

Democrats have paid the company owned by the politically active daughter of compromised Judge Juan Merchan at least $12.7 million in the first half of this year.

Ex-Trump attorney agrees to cooperate in Arizona fake electors case

 

Jenna Ellis, Donald Trump’s 2020 campaign attorney charged in Arizona as part of the fake electors scheme, has agreed to cooperate with prosecutors in exchange for getting her charges dismissed.

Arizona’s attorney general, Kris Mayes, announced the deal on Monday, sharing a legal agreement that shows Ellis agreed to sit for interviews and turn over documents related to the scheme. The agreement also calls on Ellis to “testify completely and truthfully at any time and any place requested by the Arizona attorney general’s office”.

 

In exchange, Ellis will avoid potential jail time for her role in the scheme.

“This agreement represents a significant step forward in our case,” Mayes said in a statement. “I am grateful to Ms Ellis for her cooperation with our investigation and prosecution. Her insights are invaluable and will greatly aid the state in proving its case in court.”

In Arizona, 18 people were charged – the 11 people who falsely attested that Trump had won the state’s electors, and seven others from Trump’s circle who helped coordinate the scheme

Supreme Court rejects Missouri's bid to halt Trump’s sentencing in N.Y. hush money case

 

The U.S. Supreme Court on Monday rejected the state of Missouri’s long-shot bid at halting former President Donald Trump’s sentencing and gag order in his New York hush money case. Missouri had argued that the rights of Missouri voters to hear from presidential candidates were being violated by the New York criminal proceeding.

U.S. District Judge Tanya Chutkan has once again taken control over the 2020 election-related prosecution against former President Donald Trump and could soon lay out how the case will move forward in the coming weeks. 

 

Chutkan's work is likely to be most consumed in determining whether the rest of Trump's alleged actions — namely that he worked to organize false slates of electors, communicated with outside attorneys to execute that plan and urged his supporters to descend on Washington on Jan. 6 — fall within the scope of official or unofficial acts. 

 

As the 2020 election-related case against Trump appears to get going again, Smith's other prosecution against the former president was dismissed by U.S. District Judge Aileen Cannon in Florida last month after she found the special counsel was not legally appointed. 

Smith has appealed the ruling and litigation is set to commence later this month, but Trump's successful challenge of his appointment in the classified documents case could pose further challenges to the case in Chutkan's court.

Just hours after the case was handed back over on Friday, she scheduled an Aug. 16 conference to chart the course for handling numerous unresolved issues in the case — likely teeing off a discussion over whether to hold what some have deemed a minitrial.

And Saturday, she ruled against Trump on a pending bid to toss the case, determining he failed to demonstrate any prosecutorial bias on the part of special counsel Jack Smith in bringing the case.


 

 

The public will get their first look at Smith’s thinking on the matter by Aug. 9, when Chutkan has ordered both sides to jointly lay out their vision for how they think the case should proceed.

 

It’s possible Smith could ask for an evidentiary hearing — something some Trump critics see as a “minitrial” that would allow the public to learn more about the evidence prosecutors plan to offer

 

The Supreme Court’s ruling last month determined former presidents are immune from prosecution for actions they take in office that are part of their core executive functions, and that they are presumptively immune for all other official acts.

 

In doing so, the justices called out one specific element of the indictment, barring use of Trump’s pressure campaign at the Justice Department as the basis for any charges. 
 

But it’s now up to Chutkan to parse out the rest of the indictment and determine where else Trump might be protected from prosecution — and which elements of his plot to stay in power can still land him prison time.

That process could take two routes: arguments on paper, or a hearing featuring live witness testimony.

Why is it when the judge was appointed by a Republican they are branded with that by the MSM, but when a Democrat appointee, they are some sort of wonder judge?

On Friday, U.S. District Judge Chutkan approved Smith's motion requesting additional time, granting Smith until August 30 to lay out his case against Trump following the U.S. Supreme Court's July 1 ruling on presidential immunity.

Donald Trump loses 3rd bid to remove Judge Juan Merchan from hush money case

Merchan called the arguments a "repetition of stale and unsubstantiated claims."

 

‘Stated plainly, Defendant's arguments are nothing more than a repetition of stale and unsubstantiated claims," Merchan wrote in the three-page order.
