I used to be agnostic on the victor in the 2020 presidential election.


I simply didn't know since our system is so botched and riddled with holes in almost every state it's difficult to determine the winner in any of our elections that are even relatively close.

 

I still remain somewhat agnostic, but the tenacity, resembling monomania, with which our Torquemada-like special prosecutor Jack Smith seeks to indict and convict Donald Trump leads me to believe Mr. Trump actually won.


Many may also feel that way because of the manner in which Mr. Trump's poll numbers tend to grow the more he is indicted.


I admit my reaction is to some extent psychological/emotional, but it does have a factual basis.  [...]

Trump loses bid to move hush money case to federal court

 

Former President Trump on Tuesday lost his bid to move his hush money case from New York state courts to federal jurisdiction. 

Why it matters: Trump is due to be sentenced later this month in the case, in which he was found guilty on all 34 felony counts of falsifying business records to conceal payments to adult film actress Stormy Daniels. The ruling means the case will remain with state Judge Juan Merchan.

 

  • Trump unsuccessfully tried to argue Merchan was biased against him. His lawyers are also trying to get sentencing moved to after the election.
  • "It would be highly improper for this Court to evaluate issues of bias, unfairness or error in the state trial," federal Judge Alvin K. Hellerstein wrote. "Those are issues for the state appellate courts."

What's inside: Hellerstein also rejected Trump's request for a new assessment of how a recent Supreme Court decision shielding presidents from legal liability for official acts relates to the hush money case.

  • "Nothing in the Supreme Court's opinion affects my previous conclusion that the hush money payments were private, unofficial acts, outside of the bounds of executive authority," Hellerstein wrote.

This is a question I've pondered about in the case of New York's Acting Judge Juan Merchan.  He is the judge presiding over the bookkeeping and non-disclosure agreement case of Donald Trump.  What happens when you hide evidence of a pattern?  Ironically—and illegally—Judge Merchan and the people at the oxymoronically-named Ethics Commission for the New York State Unified Court System have been hiding the judge's records and disclosures since 2018.  America First Legal is suing both Merchan and ethics overseers for illegally hiding the judge's disclosures for the past seven years.  [...]
