Lawfareland gets nervous

This newsletter has noted that the elected Democrats, Biden DOJ-appointed prosecutors, legal activists, and others who have filed criminal charges and lawsuits against former President Donald Trump have crafted a multiple-redundant line of attack.  If one case fails, there is another to back it up, and if that case fails, there is another to back it up, and so on.  There are four criminal cases against the former president, all charging him with felonies.  [...]

The Cases Against Trump: A Guide

Fraud. Hush money. Election subversion. Mar-a-Lago documents. One place to keep track of the presidential candidate’s legal troubles.

Not long ago, the idea that a former president—or a major-party presidential nominee—would face serious legal jeopardy was nearly unthinkable. Today, merely keeping track of the many cases against Donald Trump requires a law degree, a great deal of attention, or both.

Clay Travis & Buck Sexton made the point recently that they can name no other American with a clean criminal record who was then suddenly charged with multiple felonies in multiple jurisdictions after the age of 75.

Word on the street is that the "Jan 6 Committee" hid evidence proving that Trump called for National Guard troops to protect the Capitol.........If true, it's time for some serious consequences for the members of that kangaroo court......Can you say prison time for Raskin and Chaney??

Jan 6 committee allegedly suppressed testimony showing Trump admin pushed for National Guard presence: report (yahoo.com)

what's good for the goose is good for the gander - which is why one should really think twice about laughing about trump being indicted for political points.

He crimed before and while in office on the first round. The accountability began before he threw his hat in . One may recall it was after indictments started to materialize….one could even point to the exact moment that genius lightbulb flickered .

It’s not the charges themselves that arouse suspicion, it’s the timing of the cases to impact the 2024 Presidential Elections and the campaigning cycle that precedes them, that stokes the fear of state-sanctioned electoral interference.

What is ironic is the political capital DJT is deriving from this very obvious attempt to sway the electorate. That none of the prosecutorial actors can see that, regardless of the outcomes, the interference is having the opposite effect to that which they desired is truly mind-numbing.

Rough Day in Court for Trump Legal Team As Judge in Hush Money Case Rules on Pre-Trial Motions

[...] The case may not be proceeding on its originally appointed date, but it looms nonetheless.  With the trial date fast approaching, the parties have filed and presented their "motions in limine ' (pre-trial motions) to the court.  These are essentially motions seeking preliminary rulings from the court on various evidentiary matters.  They serve several purposes: streamlining the case ahead of seating the jury, preserving issues for appeal, and sometimes framing the case and issues for the judge with the hope of setting up favorable rulings throughout the trial.  Both sides will essentially ask for the moon, recognizing you rarely get everything you ask for — but if you don't ask and properly preserve the issue, you may not be able to raise it on appeal.

Which brings us to Judge Merchan's rulings Monday on the parties' motions in limine.  In a nutshell, they largely favored the prosecution and not the defense.  [...]

Defense got to exclude the Grab Them By the genitals Tape …but asking to block Cohen and Daniels seems mildly absurd 😂

Judge in hush money case denies Trump's bid to prevent Michael Cohen and Stormy Daniels from testifying

Judge Juan Merchan also said prosecutors could refer to, but not play for a jury, Trump's "Access Hollywood" comments.

A New York judge on Monday denied Donald Trump's bid to keep his former lawyer Michael Cohen and adult film star Stormy Daniels from testifying in the former president's criminal trial related to a 2016 hush money payment.

State Judge Juan Merchan gave Cohen and Daniels the green light to take the stand but placed some restrictions on Daniels' testimony, specifically that she can’t testify about a lie detector test she took in 2018 indicating she’d been truthful about her comments about Trump.

Great piece, loved this part.  The Left/Dems/AntiTrump factions are really getting frustrated.  Their Superman Jack Smith is failing.  Fani is hopelessly damaged, and she has no hope of rushing any case to a courtroom (heard the story of another RICO case in GA that has taken over a year to seat a jury, apologies, no reference, and could be hearsay).  Of course in NY, they are throwing out the Constitution with respect to Due Process (5th and 14th Amendments), I wonder if NY will require someone sentenced to death to die first before they can appeal,  and the 8th Amendment.  We shall see, but as with any cornered animal, I expect the Left/Dems/Never Trumpers to get more desperate considering they have to rely on Old Corrupt Petulant Joe Biden.

Let's Go Brandon!

Americans are turned off watching “people in positions of great power and responsibility, in the midst of a campaign, would use the justice system to ‘curb’ one of the two major presidential candidates. They might find it outrageous that those people, a coalition of elected Democrats, Biden administration appointees, Democratic Party activists, and career lawfare specialists, are in fact desperately pushing the system to work faster to win verdicts by Election Day.”

Your strategy is backfiring. No American election has featured this much meddling by the judicial system, and this much naked partisanship from the Justice Department and its proxy, the state of New York. It does not sit well with the American sense of fair play. You blew it. You threw it all against the wall and nothing stuck.

Does it really matter, Trump will be found guilty by a stacked Manhattan jury.  It might be interesting seeing Daniels and Cohen (I also heard Ms. McDougal was going to testify as well) testify, cross-examination might be interesting.
