AOS RFE for “initial” evidence already submitted

Hello all,

 

My (now) wife (K1 visa) and I prepared and submitted the AOS paperwork, etc. on June 30 this year.  We have been taking care of biometrics and just waiting for any other updates.

 

Last night we received an RFE for my stepdaughter (K2) which apparently indicates that NOTHING was submitted for her as “initial evidence”.

 

No I-864

No I-94

No I-693


I’ve seen posts essentially indicating that the USCIS lost or cannot find the medical examination, and so an I-693 is requested again even though it was done and is in the possession of the USCIS.

 

However I have no idea why the I-94 and I-864 is shown as not in the initial evidence, as I have copies of everything which was sent here in front of me.

 

I-94 submission for K2 included:

- The I-94 form printed from online

- The passport / visa entry stamp

- The marriage certificate

 

As a K2 applicant, a separate I-864 wasn’t completed.  The stepdaughter is on the wife’s I-864 as a family member.

 

I-864 submission for K2 included:

- A copy of my wife’s I-864

The supporting documents (tax transcripts, etc.) were not submitted a second time 

 

My question is what needs to be submitted differently since everything was submitted the first time - am I just to submit it again?

 

How to get some clarification on what is missing - like from the actual person who submitted the RFE?  Because if I submit the same information again it’s likely to end with the same result, no?

 

If we must get the medical examination completed again, then I guess there is no choice.

 

Just looking for some advice.

Some members from a specific office -Atlanta if I remember correctly- reported receiving a request for a medical even though many were K1 and submitted evidence about going through it already.

 

You have the choice to get K2 beneficiary go through medical or send the same medical exam evidence again.

As for the I-94 and I-864 send everything again (including pay stubs, tax transcripts, etc.)
