Great layout, thanks!!

I called the 'helpline' today to enquire as to whether my 8 year old daughter would be receiving biometrics anytime soon. I wasnt sure if there was a requirement or not.

I was informed that she should have been made an appointment within the first 30 days of filing, for pictures and

signature?, and that they would send a request for the appointment within the next 45 days.

I was then passed onto an Immigration officer regarding the lack of online case status for my EAD.

She told me that she would send a request and I should be able to see it online within 10 days.

Not sure whether they make this stuff up as they go along...lol

Anyhows, just an update in case youre interested!

My Ead was approved on August 6th ( I filed before my AOS due to my I360 being approved.) I don't know what to put ,but I know it took only 42 days. However this would look confusing in the stats. By the way how can you copy the table? Everytime I do it it goes all wonky.

Need help. I did my AOS paperwork received my NOA1 and appointment for Bio is this friday. I received another letter yesterday saying I forgot the paperwork for I-864 avidavit of support. I did all the paperwork and included my tax return papers but did not send copies of my W-2's forms. And it says I have 60 days to get this information in are my case will be denied. Well I'm sending this information to them tomorrow. Any Idea if this will have a delay affect on my case and how much longer the delay if any might be? Thanks Dynamo Dean

Dynamo-Dean,

Just send in everything again you already had for the I-864 and include the W-2's this time. I don't think it should delay it too much as long as you send it back in right away for them to continue processing it.

I got an RFE that i posted a few pages a go, and they are asking me for all my info again too, even though I sent them everything and my husbands income is above the poverty line.

Hopefully we'll all get through it fast and smoothly. :)

My RFE states:

F (25) The petitioner or joint sponsor's income as reported on the federal tax return submitted with Form I-864 Affidavit of Support does not meet or exceed 125% (100% if military) of the poverty line. The petitioner's or joint sponsor's current income as reported on Form I-1864 or I-1864EZ Affidavit of Support is insufficient but no evidence has been submitted as proof of the current income. Submit evidence of the sponsor's current income. Evidence includes a letter of employment from current employers and should show dates of employment, the nature of the job(s), wages or salary earned, number of hours/weeks worked, and prospects for future employment and advancement. The sponsor should also include paystubs for the most recent 6 months.

Hey everyone, my cases still can't be tracked online but I did received an RFE today, so at least I know they are working on our case. My husband is self-employed and we had mailed in his past 3 years tax returns (all of which are above the poverty line), the schedules that are filed with his tax returns and his 1099's.

Should we just re-send all 3 tax returns with the schedules and 1099's again? Along with the past 6 months bank statements and a letter on his own business head with details of how much he earns and works a month? Should we also send his business license, and information on upcoming work? We don't have a joint sponsor, but do you think we should find one just in case? Would it be easier to file with a co-sponsor that is not self-employed and has actually W-2's?

Any advice would be greatly appreciated. I'm just a little confused as I've seen other's who had mailed in Affadivits that their sponsor was self-employed and they were asked specifically for the state license and stuff.

We had the same RFE, and I basically sent in everything I could lay my hands on, to show my hubby's income was

above the line. I also added in my cover letter in BOLD, that should the enclosed evidence not be sufficient in order

to complete processing, we have a co-sponsor at hand.

We have a few people who are aware of our immigration situation, that if asked would probably be willing to help, but basically I added that to avoid an outright denial. Should the evidence not be enough, then we will deal with

that when it happens. Its not like we have any other choice but find a co-sponsor, if they require it.

Also our initial employers letter had been a basic, hours, length of employment and annual salary job.

We asked hubby's employer to be more specific to include future prospects, specific start date and duties.

We haven't had any further correspondence from USCIS, so I don't know as yet as to whether they're happy with

what we sent. We'll see...

Hopefully, it will be adequate..but hey who knows...

Good luck, send everything but the cats whiskers IMO!!!

I had my biometrics today, which was quick and easy. However when I got back home in the mail was RFE like many others it was asking me to send W-2 either for my sponsor or joint sponser. In our initial application my husband wrote a letter explaining he hasn't been earning enough to send in tax returns. I wander if we should resubmit another letter along with the W2 or just send in W2s for my joint sponsor.

The other thing the letter said was that I am ineligible for interim employment authorisation until 90 days after the missing evidence is received. If this is a reality and means I won't get my ead for another 90 days then I am seriously pissed. I had a job interview yesterday. I explained that I had my biometrics and will receive my ead soon after possibly about 6 weeks, this did :blink: not seem to deter the interview but if I am offered the job and I have to tell them I have to wait another 90 days well I think I can say goodbye to that job.

Hya,

In regards to the 90 day standstill on the interim EAD, it seems from most peoples experience that processing resumes once the evidence is returned. This was also confirmed to me from an immigration officer on the 'helpline'.

The email I received a few days after my RFE was returned, stated that processing had resumed, so Im ASSUMING the only hold up is the time it took to return the info.

THanks for taking time to post this in thread, great information and help I think to AUGUST FILERS! Curious what office or location did this RFE get mailed out of to you, for example I wonder if it was Chicago or your local based field office? Hey I feel for you. I had never heard of state license and stuff being asked for.

Only other things I would recommend are to

1) Send like 6 or 12 months of husband's current bank statements or savings account statements

a) stock brokerage accounts or mutual funds, IRAs, 401k or any other retirement account or pension information to prove assets

B) might consider your home or property title or deed to home you own or he owns that you live in

c) also black out any account id or personal information prior to sending in

2. Get all his 1099s if he has them and make copies of them and mail in

a) he will not have any W2s since he is self employed, W2s only come from employer you work for.

B) so letter from employer will do you no good since he does not have one and is self employed. I suppose this is where some sort of state license could be submitted or copy of to prove his profession, never heard of that being used but cannot hurt.

c) I would also call the IRS hotline and ask for them to mail you(your husband will have to do this himself and call the IRS they will not speak to you or allow you to request this, he will have to) the 3 most current years worth of IRS tax transcripts - 2006, 2005, 2004. They do not clearly say this or ask this on the I-864 but apparently this is what they expect and mean and seems to be tripping up quite a few people on here in AUGUST FILERS. This is really all that should be sent to them anyway, it is what the official transcript or record is on file with IRS. So why they ask you for copies of actual income tax return is beyond me if they are getting a IRS tax transcript, it is purely overkill but send it anyway since that seems to be what they demand of you and they do not make it crystal clear in their I-864 instructions.

d) Also send photocopies of 2006, 2005 and 2004 federal tax returns. AND remember if your husband is self employed you will also have to send in copy of the schedules B, C, D and E that go with the federal 2006 income tax return if he had to file these schedules for the current tax year return which is 2006, do not have to send in copies of 1099s or W2s or schedules for 2004 or 2005 tax years.

3) You may try sending in copies of your husband's current year's invoices that your husband has billed to customers and they have paid(showing copies of checks he recieved for payment) and possibly have potential customers of his or past customers of his this 2007 tax year write letters of reference or recommendation stating how much they spent or paid to him or plan to pay him in future describing type of work he did with dates and maybe hours he works and get it from customers for you sending that in yourself will not do any good I am sure they expect it to be from a third party to verify and prove your husbands income independently,

Although from the statement I read above that they make to you on reason for RFE is contradicting, one sentence they indicate your husband does not have enough income to meet guidelines thus you can tell if your husband is below the poverty guidelines for his total income(line 22 of form 1040) by comparing that number to the federal guidelines poverty numbers chart(which I do not have off hand near me now and I have forgotten them I would go online and do search for them or ask someone on here for them or check the guides section of this website for them) YET then they ask or in next sentence they demand you to resend in to them 'proof of current income' which would mean for this current year of 2007 any work your husband has done and earned money from which ties back into first part of this statement I made. Thus I agree it is very confusing and frustrating for people and outright not fair, for example if you are a W2 wage earner you get a free pass and not all this hassle or RFE business whereas if you are retired or a self employed or owner of a business they discriminate against you and demand things from you that are not truly possible which leads me to believe they ask for all this financial proof and docouments of information and truly do not know how to read it or intrepret it, thus they are trying to do the IRS's job or an accountant's job which I am sure they are not able or qualified to do, thus I hope you see why I tried to start a post or thread about AUGUST FILERS RFEs(which was bashed and battered and shut down by an all-knowing, rude, classless God complex Moderator :P ) and why and how many were and what kind they are to see if there is a tendency here or pattern for RFEs in August. Which it would appear there is. And I do not know what to tell you in one sentence they say your husband cannot or does not qualify due to poverty guidelines then in next sentence they say send proof of current income, well if he does not qualify then why bother telling you that and why not just say you need a cosponsor now, instead of making their illogical contradictory statement or directions.

4) IF you cannot find information to prove your husband's current 2007 income or earnings or revenue as suggested THEN you better find a cosponsor that preferably has a W2 form from their employer so you can submit that to this case worker on your RFE and be done with it and move on to save time, for I am afraid they may RFE you again or hold you up if you do not send in what they asked exactly, seems that they just go down a little checklist looking for items a person submits and if you do not have them, then RFE, no matter the exception or their own written instructions on I-864.

Hope this helped, I feel for you like all others on here in August and what they are getting RFEd for, when they have only followed the instructions and done as they are told. I cannot help but believe it is a game USCIS plays for I truly do not think anyone on here is just going through all this for kicks and grins and deliberately does not follow directions which leads me to conclude, there is a pattern here and something is amiss with these RFEs in August Filers. :ph34r:

I agree that it is indeed, helpful to hear other peoples experiences but I think the month at which they filed is irrelevant. There are as many people RFE'd in May filers, June filers etc etc, no pattern.

Still, I saw that the thread you started ended up being closed, so lets not contaminate this one too, eh?

At last I my can check my process with ead but not aos. At least the RFE told me they had at least looked at it. My father in law who is my joint sponsor is away until the weekend so I'll have to wait until Monday before resubmitting his W2s and then hope they will resume processing my case.
