You are probably right, thanks for info, was not aware of that, just doing what we were told by Social Security office when we first applied for the card after 2 weeks from arriving, so that is probably what has happened, no big deal, just trying to do the right thing and do as instructed by ss office worker, funny how the government agencies and their workers are not really up to speed on their own policies or rules, but I am learning fast.

What I have heard is that you can do it with a work permit (the EAD). Several people here did that. You will still get the same thing written on it, but you should be able to get the name changed.

That's what I'm going to try to do as soon as I get the EAD. There are a few posts about this in the 'working and traveling prior to getting a GC' section.

Thanks for info. we will just let it pass and go to AOS interview and take care of it after that time, we are hoping that will be within one month or so. We realized there was really no need for us to pay and apply for EAD and travel stuff since by time it comes we will be getting green card in about same time after AOS interview, so we never bothered applying for those two. That makes sense on the name change 2 weeks prior to end of 90 day K1 period, seems to ring a bell somewhere from something else I read long long long ago. so many nuances and steps and rules to keep up with on deadlines with this process, which is truly utterly ridiculous how complicated our government agencies make this whole process, just glad it is now down to AOS interivew, waiting on infopass letter now so that can be scheduled and done with. I hate to say this but I see why so many people come to the USA illegally now, and have the attitude of why bother nothing will happen to me anyway, I mean our immigration system cannot even handle or work properly with those of us here doing it legally, let alone the illegals, it has been a true eye opening experience for me to see how broken and poorly operated Dept of Homeland Security is operated and then it oversees INS, and then this FBI background and biometrics check, I am like why bother and wait until they arrive or are already here in USA, it should have been done before they are allowed here or entry and performed at the American Embassy during that interiew process, no wonder I read so many stories on here of others getting such a run around. HAHA oh well, what a mess it all is and all this paperwork and documents to submit which why? any two Americans getting married do not even go through all this paperwork to get married, maybe if they did there would be a lot less divorces and more serious marriages in the USA between two Americans, just a thought that I have cross my mind after going through all this and jumping through all these hoops and playing the game wit INS and Dept of Homeland Security! AHA oh well only in the USA.

Anyway, hope this helps others, and for this matter it may change or vary from state to state or office to office I am afraid there is no consistency with all this K1 process.

ZQT3344

Sorry to hear about this.

Could you try going to another SS office? Maybe it was up to the manager there....not sure about the polices but something doesnt sound right.

Wendy applied for her SS card after we got married. No problems at all. We got her card with my last name. We took the marriage certificate, passport with I94 and that was it.

Update: We have our biometrics appointment on the Oct. 12th ;)

Garya:

THanks for info and reminder, sure that is what has happened, we got married toward end of 90 day k1 period, then honeymoon and then busy with other things and life and filed for name change when we finally had free day to take off and go do it about month and a half after wedding. No big deal for us, just thought others might like to know to save them time and help them out later. Thanks for info.

I didn't see that you had not applied for EAD. Sorry, it's true that in this case you have to wait for the GC.

Now am I reading wrong or are you saying that you are making an infopass appointment to get an interview date? You do know that USCIS is the one who scheduled the appointment right? I mean unless you have a very good reason for it they don't do scheduling upon request. I think the only rare cases when they make the process faster is for people in the military who are about to be deployed.

Add to it that your local office seems to process AOS in the 6 months period, so they are obviously busy and it might take a while until you get an interview.

And by the way the EAD usually is approved between 60 to 90 after the package is received in Chicago as it's processed at the NSC (usually processed separately from the I-485 after being received) not that it matters much now though, it's also a good back up if you get stuck in FBI name check, but that's always a personal choice and I can understand not wanting to pay the extra money for it.

And others on here, just to share an experience with everyone. We went to change the name on social security card we applied for and recieved before wedding, was told that would be no problem to do after the marriage and to bring into Social Security office copy of marriage license, and passport with K1 info in it, etc so they could update the card to new surname. Well went to local security office 2.5 weeks ago to apply for surname change on social security card, person there handling it took info from us(although social security lady worker kept screwing up the application not once but twice we had to look at it and tell her it was not being entered in system correct, hard to believe but it happened, anyway) then told us no problem to change surname on social security card and able to do up to 3 or 4 times a year no charge or problem and to wait 2 weeks, congratulations you will get new card in 2 weeks, well instead we get a phone call from another lady working in same social security office yesterday telling us that sorry but you were misinformed and that INS would not allow the social security office to issue a new card in the new surname, only after receiving green card or AOS interview approval of green card could we apply and would have to come back and reapply all over again! AHAH I asked ok but why were we told this incorrectly first time and why not issue it saying "not eligible for work" like the last card did? Never got an answer just that they could not do it now, so just to give everyone a heads up to same them some time or confusion, I suppose now you cannot apply for surname change on social security card even if having marriage license you still have to wait until after you get the green card, which we checked on getting a driver license and were told we would have to wait until the green card was approved, not sure if this is for certain or if all these government agencies are all just screwing down tight now and afraid to do anything in gray area until it is for certain a person has a green card. We had been told we could get a driver license without green card but looks like that is not true. Anyway, hope this helps others, and for this matter it may change or vary from state to state or office to office I am afraid there is no consistency with all this K1 process.

On a K1, once you get past 76 days on your I-94, SSA will not change your name until you have your GC.

This is true... When I applied for my SSN, the lady there told me that I did the right thing of applying for SSN 2 weeks upon my arrival here and had my name changed on it a week after we got married. She said when the date on the I-94 is close to expire, they will not give me SSN nor change my name on it until I got the GC.

Hi, that would be correct and us, had no idea someone on here would be at a place like us at same time, well small world after all. We got there around 7:15 am and waited around the door then decided to just to sit down, then came back and there were people there waiting and you would have been one of them, you were on front row next to us filling in your clipboard that morning. I remember your husband sleeping or falling asleep while waitingfor you to finish then you and him asking questions at counter when you were done. As far as being able to go online and check status of our case, no we have not even checked, not sure how to do that, had read on here that it is not really that up to date or accurate, so did not bother with it yet. Wonder how and where at you are checking at on this?

Hi there, here's a quick update from me.

genxv

Biometrics: 09/18/2007

I'm happy to see that all the cases are progressing nicely. My biometrics appointment was very quick and surprisingly pleasant. In my experience officials and government workers can be very brusque and unsmiling (again, this is just my experience, I know most of them are not like this), so I had expected to be grilled and scrutinized. Well, none of that really, everyone was very nice. I filled in a questionnaire form, was fingerprinted, photographed and then I was done. Hurrah! Neither my I-130, I-485 or I-765 are showing up on USCIS online system yet, but I'll be checking in frequently.

Cheers

Curious so when do we or should we expect to receive our AOS appointment letter in the mail, the ladies at biometric desk told us that within 4 to 6 weeks we would be getting something in the mail with the AOS interview for green card appt time and date and location, they said for us to just wait now until we get that letter, does that sound right and is that how it works now, I mean we never had any letter telling us when the AOS appointment would be, just the biometrics and the NOA1 that they received our application and check, you know this is a lot to keep up with and trying to live normally and work.

Also this new way or system which they make us all apply in Chicago and sit and wait and go at their slow pace sucks. Talked to some people that went through getting their greencard back in 2002 and 03 and 04, said they just showed up at their local field office and waited in line all day or however long it took or scheduled appointment directly there, then brought all their forms and documents with them on the spot, must admit, wish it were still like that, we would have already been in over two months ago to do that, I think they changed this process sometime in mid 2005 or first of 2006 to the way it is now, how we all sit and wait and hope and wonder and pray for speed and quickness. :)
