I-751 and Expiration of Green Card

Timeline

Let's say an I-751 is submitted before the Green Card expiration, but the USCIS reviews the submission and finds a problem AFTER the expiration. Is that simply an RFE or are Green Card privileges lost because the submission wasn't "properly" filed before the Green Card expired?

Only an immigration judge can revoke LPR status.

If ROC is not properly filed -i.e. wrong fee, missing signature- and the packet is returned once your conditional GC expires, you need to file again including a letter explaining why are you filing late. Same would apply if the case is denied.

 

RFE's are issued in case there is a missing document, unchecked boxes or insufficient evidence.

 

You don't "lose privileges" but an NTA can be issued while you're out of status.

Thanks for the responses. My question comes from the fact that I'll be out of the country about 8 after the beginning of my 90 day window to file the I-751. I was thinking about filing shortly before I'm away (so there's less chance that I receive the biometrics appointment while I'm gone). I'm just worried about the risks of not filing it as soon as possible.

 

I think the safest bet may be to submit at the beginning of my 90 day window and just reschedule the biometric if it happens to land on a day that I'm away.
