My I-751 has been pending for 31 months

I know of nothing in INA that says otherwise. AFAIK, CBP did not find Judy to have abandoned LPR status when Judy returned.

I know, technically he's LPR based on Resident Since. But the absense is also on the borderline of 6 months. What if the OP left the US on January 3rd and came back on June 20th? That would be 169-2 = 167? Of course, can calculate more precisely if exact dates are provided.

 

I think it'd make a much cleaner case to start counting residence since return in June 2019.

I left on January 3, 2019. I came back on June 9, 2019. 
 

Let me reiterate - I nearly died from emotional and psychical injuries sustained by my ex-spouse abuse. I was hospitalized on and off for that long between January 3, 2019 and June 9, 2019. My medical expense was nearly $20,000, which I have still not been compensated yet. 
 

135 days in a living hell. I wasn’t going on a vacation. “A lengthy trip” sounds like I was having fun on that lengthy trip. I am sorry I come off as so negative. I understand you mean well and are trying to help me. :) 
 

Any U.S.C.I.S. officer who assumes I was having fun or on a vacation when I was out of the country between 1/3/19 and 6/9/19 would be heartless and senseless. 

 

But I’m not actually concerned about my I-751 pending for so long after I read you guys’ replies. I guess what I need is just an I-751 support group haha.

Jan 1 2019 to Jun 30 2019 is 181 days including Jan 1 and Jun 30.

 

The day of departure from U.S. and day of return to U.S. count as days in the U.S.  

 

181 - 2 = 179.

 

I am not seeing the problem. File N-400 in 2023. September 20, 2023

I didn’t try to argue with you or anyone else.  I even explained that I understood people were just trying to help.

Thank you for clarifying the dates, this is less than 180 days thus your case should be approvable if filed in after September 20th 2023 (provided all other eligibility criteria is met).

I am really sorry you had to live through abuse and hard times in your life. Nowhere I suggested that you had fun etc. My usage of "lengthy trip" wasn't implying any negative connotation or assuming vacation. Trips are trips and can be due to many reasons: family emergencies, business issues and other. I'm sorry if you felt I used words to shame etc, I had no such intention. All I was trying to establish whether this can be a point an IO can stumble upon. Doesn't look like it would be.

 

Be ready to prove your case and fight for it though, not every IO is a nice sensible person. That applies not just to you and your case, anybody can face it in their immigration.

 

Good luck with I-751 and N-400! I hope you have a good smooth application and quick approval.

 

By the way, did you convert your case to divorce waiver case?

I did petition my I-751 on divorce waiver, along with abuse and hardship if returned to my home country.
 

Seems the U.S.C.I.S. is so far satisfied with my paperwork after I sent in TWICE dictionary-thick documents. The status has been changed from RFE to “ready to be scheduled for an interview” since December 2021. What could be going on???

Interview notice sent, but it didn't reach you?

06-04-2007 = TSC stamps postal return-receipt for I-129f.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

You are now in the queue for an actual interview, it seems.  We filed our I-751 in Mar 2019.....It changed to "Case is ready to be scheduled for an interview" in May 2019..No RFEs....Interview occurred in December 2022....only after submitting the N-400 in August 2022. They aren't very efficient.  There is still hope they will approve your case without an interview.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

I have been residing in the U.S. since June 2019. Never left. 

Have you looked into getting medical insurance here in the US?   Affordable Care Act?    


Not sure what your employment situation is, but certain types of employers are known to offer excellent insurance, such as hospitals and city/county/state offices.

 

So sorry for all you’ve been through.   Hang in there and best luck.
