I131 application for travel document

Hello Community!

 

My wife is pregnant with twins and I’ve just secured a job in her home country. We should be gone for about a year. We want to do the process (i131) right and ask for the travel document before leaving if possible. We need to go back because we don’t have any support here and we already have one child. My question is do we:

 

1. Do the application online

2. Mail it in

3. do the application abroad when we get to her home country

2. Is the sole option. Online I-131 is not available for your situation.

 

After mailing it, the applicant cannot leave the U.S. until the I-131 receipt is mailed back.

The receipt can come back as fast as a week, but 2 weeks is the norm.

You say they "can't" stay here.  Can't is a very strong word, often misused.  Perhaps you mean it would be inconvenient or costly.  If you want to maintain her resident status, find a way.

Are you sure it will only be a year? You might want to consider having your wife stay in the US after you leave, apply for i131 receipt and do biometrics and then join you… should only take 1-2 months. If that isn’t an option have your wife return to the Us In 2-3 months to apply (but not sure of her due date)… if none of those options are possible your wife can give up her residence and you can reapply when you are ready to move back to the US… iwannaplay54 has done this before. As long as you can sponsor your spouse or obtain a joint sponsor you can move back to the US… (you will have to show you can support a family of 5- you, your wife and the three children)

what if we break it up? Like come back in October for a week and in December for a few weeks… would that be considered permanence outside the US? Can you do short trips for a few months at a time and it not be considered “permanence” outside?

You need to factor in your wife’s pregnancy and her due date. Will she be allowed to travel during those times? Once the twins are born you will have to file CRBA for them before they can travel to the US.

You have secured work outside the US. That and your suggested travel pattern for your spouse will raise red flags. Not advisable. 
She should apply for the reentry permit. She can request it to be sent to the HCM consulate for pick up but she must not leave the US until

1. she has the notice of action for the application 

AND

2. she has either completed the required biometrics or has bern notified that biometrics on file have been reused. 

 

 This will give her 2 years from the date if issue of the permit when she can reenter the US without being presumed to have abandoned  her LPR status

You can take that risk but if you are outside for more than a year. They will presume your wife has abandoned her US residency. Depending on when the twins are due when will she return to the US? Does she want to face scrutiny and a few hours in secondary being questioned about why she was outside the US for so long? Will she want to return to the US or will she want to stay in her home country with additional family support?

Coming back to the US is what we want ultimately. Just some time with family during the pregnancy
