I-485/I-130 Second interview or an internal error?

Hello everyone,

I have been in the AOS process for over a year now and I had my interview in June (almost exactly a month ago). The notice I received at that time came to my name and under the I-485 application (but the I-130 status was updated to the same).

During the interview I believe everything went well. The officer was pleasant, kept repeating that "this and that looks good". He did not have the physical file (only digital) which he complained about because "he likes to be able to flip through things". He asked us a couple of basic questions, nothing too deep, then asked me all of the Green Card "yes or no" questions. It was done in about 20ish minuted.

At the end he said "we are done, your green card will arrive in mail". And walked us out. He did not give me anything.

I've been waiting but the case has not been updated online.

 

Today my spouse received a notice of an interview. The notice is addressed to my spouse (not me) and it came under the I-130 application. The notice looks slightly different (the time date and address is at the top, not bottom) but other than that, has almost exact same verbiage as the initial interview invitation. It does not have the "interview" header. It doesn't say anything about additional evidence etc.

The online profiles for either of the cases have not been updated, it still says an interview was scheduled in May (that the initial one). The case history has not been updated.

 

Does this mean we are being called in for another interview like Stokes? Or is there a chance the officer made some sort of error while processing our case? I have had no luck so far trying to get ahold of any live person from USCIC, the phone line hangs up on me and chat says the service is down.

So far we had done everything with no legal counsel but we will if need be. 

 

At first I though it might be an error or something but now after googling around (bad idea), I am very concerned that we will be subjected to stokes.

Any feedback appreciated.

While I have heard of I-130 interviews (which are bad news), I have never heard of an I-130 interview scheduled after an I-485 interview until today.

 

You need to hire an immigration lawyer.

 

1. Was the petitioner born in the U.S.?

2. Has petitioner been married before?

3. Does the petitioner have a criminal record?

Thank you for your response.

Yes, my spouse was born in the US, never married before, no criminal record. Clean tax history, no debts (beside typical things like car payments etc.). Works full time. Just a very normal, regular person.

OP don’t want to alarm you, but this is not something to take lightly. It’s very rare almost never happened that petitioner got I-130 interview AFTER I-485 interview conducted. In rare occasion solo  I-130 conducted ( happened to me but my case it’s not straight forward ). And usually if it’s stokes interview, the interview letter stated something about “second” interview. I think yours are different
 

when is this interview gonna be ? If you don’t have a lawyer, please consult good lawyer ( you can check AILA ) and just call as many lawyer as you can, hopefully u will get a lawyer that has opening for consultation asap. 
 

call / chat EMMA during business hour. I think 8 am local time to 7 pm if I’m not mistaken to check is this real interview. This is the only time that EMMA actually useful. Say “info pass” and for the next question just say “live chat /agent” I think about 2 times / 2 questions to by pass bot.

The officer that interviewed us even said to me during the interview that "this is for a permanent green card".

Thank you for your response. I am definitely concerned and will reach out to counsel, the interview is in a month. I am afraid of the stokes interview mostly because I get really nervous about things like this (job interview etc.) and don't want to look bad.

I will bombard the call line/emma tomorrow. I tried the method you mentioned and it hung up one me multiple times. Fun fun...

 

I am trying to stay positive and strong, my spouse is surprised as well, but we will pull together and push through!

Another issue that was worrying me is that I got a 693 deficiency notice (with a deadline of 7/6) a little bit before our first interview notice. I brought the medical exam file with me to the interview, since it was before the deadline. The officer scanned it in in front of us, said everything looked good and kept the physical file.

 

Since the case has not updated, is sent them a message on the 30th asking if there is anything I need to do (since I do not have the original anymore). They never replied and then the request expired and it was said that I missed my deadline. Same day I submitted unsolicited evidence with a scanned copy of the exam and a letter explaining the situation. They did not accept the evidence until the 16th and now it changed back to say "we received your evidence and will review it".

This was the only "issue" I was worrying about, I was convinced that the case was approved.

Just wanted to provide some additional context.

The officer asked us this question by the way, did not ask any follow ups
