Ontario Marriage Certificate Expediting

Timeline

Hello,

 

I am getting married in September to a Canadian citizen in Ontario who will be immigrating to the US most likely with the CR-1 Visa path. Does anyone know if there is a way to expedite receiving the Ontario marriage certificate from the 10 weeks that is listed on their website? We would rather not wait an extra 10 weeks to start the process. I see online that I can provide a "Proof of Urgency" with supporting documents. I also called Service Ontario and they said the proof of urgency has to be from a lawyer or immigration with some sort of deadline date. Anyone have any ideas for this?

That is one of the downsides to getting married in Ontario. From what I have seen here in the past there is no expedite for immigration purposes.

Do you know if the 10 week estimate they provide is accurate? Some places online I see that it could take even longer (like 6 months??).

 

Also, do you think it is worth a shot just sending a letter of urgency anyways? I don't want to slow it down either if it is too different from the normal process.

I do not know if their 10 weeks is accurate. I have seen many members encourage ppl to get married State side to avoid this delay. If you're seeing places saying up to 6 months I would not doubt it. Send a letter it sure can't hurt. 

 

If there is a way to get married in the US with a JoP do it. Then have the wedding in Canada if that was planned already.

Wouldn't getting married in the US break the "90 day rule"? Entering the US with the intent of getting married here.

No such thing as a 90 day rule.

The issue is when you plan to get married AND adjust status. The adjusting status when you know before hand is where the fraud comes in.

If you to plan to get married real quick in the US on the next visit. Then your fiancé heads back up to Canada and plan your wedding if you're having one.

As soon as you have that marriage certificate you can start the I-130 and your fiancé waits out the process in Canada. Nothing illegal with this method.

This seems like a very good option I wasn't aware of. It definitely will work for immigration to the US right now. However, in the future, if I ever want to immigrate to Canada, this will not be possible to use, correct? Since Canada does not accept remote marriages like this.

Mike here it is I looked it up because it was so weird. They accept common law marriages so this seems strange.

Forget which one it is, but there is at least one state where an officiant is not a thing.  The couple just gets a marriage license, signs it, sends it back to the county and they are married. This would violate:

 

If one or both parties are not physically present at the ceremony, we won’t recognize the marriage”


Neither party would be present for the ceremony because there is no ceremony.
