Postponing next step

Hello,


We got DQ'd early this month and our case is still with the NVC. After serious thought and consideration and due to personal reasons, we are thinking of possibly not pursuing the IR-1 visa at this time.

 

Questions:
1. Is there an option to postpone the process at this point? If so, how do we go about doing this? 
2. If postponing is not an option, do we reach out to NVC or wait until we receive an interview letter from the embassy to cancel? I understand it may take a while before the case gets forwarded.

3. If we do cancel, could it affect my spouse's ability to enter the US on a tourist visa (currently has a B1/B2 visa valid until 2032) for a visit down the road?  
4. If at some point in the future our plans change and we want to re-apply for the IR-1 visa, would the cancellation in any way affect the new application?

1. Notify NVC you want to post pone. It might be too late given you achieved DQ

 

3. Of course. Your spouse has a track record of immigration intent.

Option: Do not withdraw the I-130.  Either just let it ride as is...or contact NVC and the consulate to inform them that you are POSTPONING the visa application.  

Option:  Withdraw the I-130 and DS-260.  This will totally terminate the case.  This will mean a complete restart if an immigrant visa is sought in the future.

Question 3:  Having had previous immigrant intent will always be a factor in a non-immigrant visa decision.  However, totally terminating the case might be more favorable, imo, to show immigrant intent no longer exists.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..
