Well I hate to have to come here and say this, but after 8 months of marriage my wife and I are going to get divorced. Were going to do it here in Mexico then I'm going to take off once its finalized.

 

Her I-130 is still in process. If it gets approved during the divorce process and I ignore the RFE's I assume nothing will move forward correct? If we don't go to the interview, if I dont sign the Affidavit of Support, if we don't go to medical I assume nothing will move forward? Therefore I don't have much to worry about in that regard?

 

Should I write to USCIS requesting a withdrawal or something even though were not divorced yet?

 

She has not been handling this process at all so she wouldn't be able to try to move anything forward anyway.

 

Any advice is appreciated.

Once the divorce is final, contact USCIS and withdraw the I-130.  That will end her immigration process.  Do not neglect to withdraw after you are divorced.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

If you're 100% of divorce then withdraw now. No point in waiting other then to give you time to think.

You don't need to wait to withdraw I-130 after divorce finalization...You can do it now if you have tried everything and the marriage is just not salvageable anymore.

 

USCIS will send you a letter confirming it's been withdrawn and any benefit being considered with this application is now rejected.
