K2 AOS and Social Security [merged threads]

Timeline

Hello all,

 

I sent off the AOS packet for my now Wife and her son. My wife does have a social but I was told that the K2 could not get a SSN until after the AOS process was approved.

 

Is this true

11/21/20: I-129F packet shipped via USPS

11/25/20: I-129F delivered to Dallas Lockbox (Lewisville)

11/27/20: Backdated I-129F "received date"

2/23/21: I-129F fee charged to bank account

2/25/21: Text alert NOA1 Receipt/Case Number

3/3/21 :  Received NOA1 Letter in the mail

Yes I did. The weird part is when I got the NOA case numbers I got the following 

 

2 i485

 

2 i131

 

But only 1 i765 and I'm certain I sent both.

The I765 receipt is for your wife or stepson? 

That's what I don't know yet. I'm waiting until the NOA letter arrives in the mail.

Hello All,

 

My wife entered via a K1 and her 7yr son as a K2.

 

We filed the AOS process and and i was told that the minor while he wouldn't be working would need to file the i-765 along with the i-485.

 

We filed both for my wife and step son as of right now my wife has received her EAD card with AP. Her son has yet to receive anything and we filed for both at the end of June.

 

My question is do we go to the SSN local office and apply for a SSN for my step son or is that automatically done once his Green card is approved because i do i recall the SSN request being a question on the i-485 form.

 

Also asking because my health insurance policy will start nagging me about it and soon we will be in tax season.

Correct. To swiften the process of getting an SSN as, unlike K1s, K2s are not eligible for an SSN without an approved EAD or GC.

The website states EAD timelines at NBC are 8.5 months for 80%of all cases. More for the rest. Monitor your timeline on the website.

No. If you applied for an SSN on either the EAD or AOS form, it will come automatically about two weeks after the approved benefit, whichever benefit comes first.

Either I765 or I485. If you requested on both, you'll get the SSN after whichever is approved first.

SSN is not required to receive HI coverage for immigrants not eligible to have an SSN. Until the immigrant receives their first immigration benefit making them eligible for SSN, your HIP cannot hound you. Ensure you are talking directly to your HIP and possibly a supervisor and never deal directly with your employers' HR. They are clueless.
