No idea where the documents are, and I am not looking. It was from a year ago. I am confused on why you are confused lol. There is nothing usual about it. I thought it was common knowledge that you had to support your immigrant spouse during and after marriage. I found the below article which admittedly may have answered my original question (answer: for life)

I did Have a pre-nub, thus my low payout. I don't think you understand. I have nearly 6 million in assets. Much of this is liquid. In the State of CA, she was entitled half of everything we BOTH acquired AFTER marriage.

Not unless you have a prenup.

4 years marriage and 250K settlement is high. Even of your were contribiting the full ~60K or so toward 401k, she should be getting just ~120K

That your prenup had zero alimony was a problem.

My wife entered on a K-1. Of course we did a prenup. But given I-864, there was no way the prenup could stipulate zero alimony.

I am not unhappy with the payout. Also, the 2k is not that big of a deal, just didn't like the idea of her being a bum for the rest of her life. LoL

Mike, nothing to cite this is what the Federal Government told me I must pay. My paystub reflects this.

If the federal government is telling you 2K per month then you should be able to cite it.

This is from the Federal Gov

No such animal to my knowledge.  Please provide a directive that dictates that.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

We are confused by the 2K per month

I think we are not confused.  The I-864 is an agreement between you and the US government which stipulates that you will reimburse the government for any benefits she uses.

It is also an agreement between OP and beneficiary. It does not say 2K

Yeah the thing that you posted is pretty much what I said. You do not have to pay her squat absent any alimony order.

I-864 is literally so if she takes one of these benefits before when she naturalizes or works 40 quarters:

1. SNAP

2. TANF

3. Medicaid (nonemergency)

4. CHIP

5. SSI

Then the government can come after you to pay them back. That's all, that's the whole obligation. You do not have to keep supporting her. Considering what a pittance the above are she'd starve to death if she were to rely on this stuff.

2k is the amount the government said I must pay, which is 125% above the poverty line. I think everyone that brings in an immigrant agrees to this. Though, the amount is different depending on where you live

Nope. 125% of the poverty line is what you need to make per year, that's all, the immigrant relative does not need to see any of this money.

You had poor legal counsel.  Good luck.  I'm out.

Demise, just saw your post (before I replied). Makes sense. Maybe I should call an immigration lawyer.

Yeah you should, ideally someone else from whoever told you this nonsense lol.

My divorce lawyer was not an immigration lawyer. However, I did talk to an immigration lawyer (didn't use them). And they told me I had to pay this for the obligation of support for 10 years. Which, he stated was unrelated to my divorce settlement. So that's where I got that info.

So if I, a petitioner, earn 130% of the poverty level, the Feds would require me to surrender 125% of the poverty level in case of a divorce?  Nope.

Seriously, get a second opinion. It also possible that you misunderstood "being on the hook for and have to make at least 125% of poverty line" for "you have to pay 125% of poverty line".
