When does that 10 years of support start and end? I-864

Question(s):

I just want to know about the affidavit of support ( I-864). I know you must support your spouse for 40 quarters or 10 years. When does the clock start for that 10 years?  

 

I was married for 4 years (to an immigrant on a k-1 visa), we have been divorced now for 1 year. When does the 40 quarters of support start? Do I count the time we were married? Do I have 5 more years or support (counting married time) or 9 more years of support (starting from divorced date)?

Ex-wife (immigrant) did not work during marriage and still does not work. 

For this question, assume she will not remarry or leave the country permanently, as I realize this ends the need for support.

There is no 10 year limit. 

 

Now she could die or leave the country. Remarry sounds more like a divorce obligation issue.

Your understanding is not quite correct. Your obligations do not end - in other words they can go on indefinitely/forever - until one the following happens which ends your responsibility:

 

1) the immigrant, your ex spouse, becomes a Us citizen 

2) the immigrant has worked 40 quarters (usually 10 yrs)

3) the immigrant leaves and abandons US residency 

4) the immigrant dies

 

The immigrant Remarrying doesn’t end your obligation. 
 

Looks like it’s in your best interest she becomes a US citizen

I'm confused. I thought I had to support her for 10 years or 40 quarters? If this is wrong, can you explain what the 40 quarters is all about? Are you saying SHE has to work for 40 quarters?

Yes. I have outlined 4 instances where your obligation ends and they all have to do with the immigrant.

06-04-2007 = TSC stamps postal return-receipt for I-129f.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

She has to accumulate 40 quarters of work credit.

IT Professional- Retired- Web Site Design, Hardware Maintenance, Compound Pharmacy Software Trainer, On-site go live support, Database Manager, App Designer.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

you must support you beneficiary for life, until a U.S. citizen, loss of LPR status, death, or can be credited with 40 SS credits

it starts from  the moment the beneficiary  starts getting SS credits

Had  you clocked a combined 40 credits while married to an LPR, at least one state supreme court says you would be free.

You need to get her to naturalize.

It sounds like I may be able to count the time I have supported her. We got her a social security number immediately when coming in the US and I put her on my tax returns each year. I am guessing those count.

I would not say support, now the I 864 has been used in Divorce settlements but they seem to be beyond this.

 

I have not seen a case reopened but not saying it could not.

Taxes are irrelevant.
