Okay i follow more data than just vj. That's based on people who had noa2 months ago, the k1 was taking about the same, if not a little longer as spousal then, it's since sped up by almost 60days for uscis stage. Even vj has uscis stage as 390 days on ave not 447 days like the link you shared

Itll probably decrease a little more while spousal will stay about the same. 

 

Even if your data was current, they are only 75 days different, 2.5months. Restarting would put them back 5months+ so for this case, it's slower 100%.

It's up to the individual. It is not superior for me or others I know. It's def not the right option is main goal is to be together asap and they're 7months in.

 

Saying itll be faster to restart is false unless the goal is a gc fast.

The only effect will be that you will have to prove you still have domicile in the US or you intend to re-locate back to the US.  You also have to show current US based income and/or assets.

Won't affect it but you may have to request embassy transfer at nvc/embassy stage which can delay it. 

 

I've not looked into it much, it's def do-able with no issue for the k1. Will just maybe affect your timeline.

I agree, you are too deep into the process, well there are some Consulates and situations where a K1 is a really bad idea bit you mention being able to move to France so that is unlikely to apply to you.

I'm the petitioner, my fiance is the beneficiary in France. I would probably look for sponsored work over there if anything. It's been rough for us and we just want to be able to be together if this is going to take another 12+ months

At this point, I wouldn't withdraw the K-1 either.  This is not the place for me to argue the other points you claim...😀

I think it's def better on paper. There's just individual circumstances and priorties that may change which is the 'superior' choice.

 

No issue with vj highlighting pros of spousal, just saying everyone should refile in answer to something unrelated can be a bit much. Esp saying it'd be faster to refile. Don't want people misled

If you can get a company move for the duration that would be cool, if you are starting from scratch well that could be difficult.

I know its is a long wait, my friend. We got our NOA1 in July of 22 and are expecting someone to actually look at it within the next 2 or 3 weeks. After that, you have to wait another 4 to 6 months to get through the embassy part of it. Its a terrible wait but what made it a little easier was thinking about how hard it used to be for people back in the day before Zoom, or Messenger. I couldn't even imagine.

If you’re thinking of moving to France with the idea of working there…I would definitely consider switching to spousal. Especially if the main goal is being together and not “being together in the USA”. Be aware if your tax returns for 2023 are not sufficient when your spouse adjusts status after entering on K1 you will most likely receive an RFE for joint sponsor. So, consider this move very carefully.
Our spousal petition took 13 months total from start to finish  and I am still watching people who filed K1 at the same time as we filed I-130 waiting to enter the US… 

The issue with immigration is one has to be very patient and not compare their case to others… K1 is one of the only petitions where the first form goes to the same center (California) so there should have been no surprises about the fact nothing has happened for 7 months… maybe you will be lucky when your partner arrives to the US and they’ll receive work authorization and green card in less than 6 months but don’t be surprised if they have to wait 12+ months for the ability to work…

Yeah, literally just came up with the thought this morning. My company let's me work from anywhere in the world and figure it's a possibility to spend 6 months or so there, but quickly googling seems like it's not easy to work in France whilst working at a US based company.
