The K1 is for people who are not married.

“If you know the enemy and know yourself, you need not fear the result of a hundred battles. If you know yourself but not the enemy, for every victory gained you will also suffer a defeat. If you know neither the enemy nor yourself, you will succumb in every battle.”

Fiance and spousal may take similar times, depends on your embassy really.  I assume someone will paste the usual k1 v spousal pros and cons

I would do a lot of reading with you and fiance before filing though as there's a lot to understand. Maybe have your fiance join as there seems to be little patience for ESL here.

Your choice... your consequences.  This "unofficial" marriage thing has caused denials in the past.  I strongly suggest official marriage and spousal visa. You have been informed.  Since you asked about both earlier, here is my comparison/contrast between K-1 and CR-1.  Only you and your fiance can decide which is better for you.

Every couple has their own priorities, and each couple must decide which visa is better for their situation.

K-1
  More expensive than CR-1
Requires Adjustment of Status after marriage (expensive and requires a lot of paperwork)
Spouse can not leave the US until she/he receives approved Advance Parole (approx 6-8 months)
Spouse can not work until she/he receives EAD (approx 6-8 months)
Some people have had problems with driver licenses, Social Security cards, leases, bank account during this period
Spouse will not receive Green Card for many months after Adjustment of Status is filed.
A K-1 might be a better choice when 18-21 year old children are immigrating also
In some situations, marriage can affect certain Home country benefits, making a K-1 a better choice
A denied K-1 is sent back to USCIS to expire
K-1 entrant cannot file for citizenship until after having Green Card for 3 years.

CR-1
  Less expensive than K-1
  No Adjustment of Status(I-485, I-131, I-765) required.
Spouse can immediately travel outside the US
Spouse is authorized to work immediately upon arrival.
Spouse receives Social Security Card and Green Card within 2 or 3 weeks after entering the US
Opening a bank account, getting a driver's license, etc. are very easily accomplished with GC, SS card, and passport.
Spouse has legal permanent Resident status IMMEDIATELY upon entry to US.
The clock for citizenship filing starts immediately upon entry to the US.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

I believe every couple should be fully informed before making such an important decision.  There have been numerous couples who changed their minds after discussing the differences.

The US citizen starts the entire process.   He/She needs to join us here asap.

getting married is not a problem because we have already done it by hand not official like the African tradition hand I wanted to know if we have a chance for the k1 or?

This likely made you ineligible for a K1.

The unofficial marriage and age difference will be huge obstacles to overcome.

Marry and go the CR1/IR1 route.

THANK YOU THEREFORE YOU RECOMMEND ME THE K-1 THEREFORE

No,   i recommend the spouse visa CR1

K1 is more expensive

K1 takes as long as CR1

K1 is often denied (for calling the person my wife)  and then u have to marry and start all over again

Our countries are harder on K1 petitions /mine was denied in 2009 and we had to meet and marry 2010

CR1 and K1 are about the same

but if K1 is denied (18 months or more later)  then u need to go thru CR1 (another 2 years)

I think it will be better if it fits here

Je crois que chaque couple devrait être pleinement informé avant de prendre une décision aussi importante. De nombreux couples ont changé d'avis après avoir discuté des différences.

I really appreciated your support I think we have to think again before deciding which one we are going to take

Cela vous a probablement rendu inéligible pour un K1.

Le mariage non officiel et la différence d'âge seront d'énormes obstacles à surmonter.

Mariez-vous et suivez la route CR1/IR1.

even I thought of her because since she is older than me and also since she was married and divorced (with divorce certificate) I think it is better to get married and file the CR1 after my analysis
