IR5 incorrect divorce date

Hello,
 

The divorce date was incorrect on the I 130 and on the submitted DS- 260. NVC requested for the divorce certificate and it was noted the divorce date was incorrect.  Divorce certificate has not been uploaded to CEAC yet. What can be done to correct this error? Thank you.

By whom was this noted?

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

1. Why are you asking about CEAC when beneficiary is in the U.S.?

 

2. When was the couple married?

 

3. When was the final divorce decree issued? 

 

4. Did the CO see the divorce decree?

Upload divorce decree to CEAC. ..presumably it’s the same document that was submitted with the I-130 . At the interview have the beneficiary state there was an error / date mix up during I-130 and DS-260 filing and ask the Officer to kindly update the record.

 

Was it an “innocent “ mistake ? Did petition get mixed up w different dates on the document? You know they are tough at Ghana ..cause they see many creative documents 😂

Lol. Thank you. So the petitioner is filing for the mom and asked the dad for the divorce date. A divorce certificate was not submitted with the I 130. USCIS didn’t catch that.  NVC requested for the divorce certificate and that’s how the petitioner realized there was a mistake with the date when petitioner  reviewed the divorce certificate. Since it is Ghana,  I suggested an affidavit to proof the correct date is the one on the divorce certificate and the one on the I 130 and ds 260 was a mistake when the mom goes for the interview.

I see . USCIS did not need the divorce to establish relationships between Pet and Benef, so they did not RFE…but as you know consulate wants everything.

 

 

You can have them do a simple one page and upload it on CEAC . Title it “ Addendum to I-130 / DS-260 Request for Record Update/ Correction” . Kindly note the correct date of Ben divorce is xyz, as evidenced by the enclosed Divorce Cert. Please update item #x on I-130 and item # y on DS-260 . The error at filing was unintentional “

 

This way consulate has a heads up. It’s not a problem at all…since it is not a marriage based petition
