CR-1 for Military Foreign Spouse, Special Circumstance Questions

New to the forum, forgive me if this post is in the wrong place. I'm active duty military currently stationed in Belgium until the end of 2024. My wife is South African and currently working in the Netherlands on a work visa until the end of August and we are starting our command sponsorship process so she can live with me the remainder of my time in Belgium. With that in mind I don't know where we need to file our I-130 forms/packet whether that's in the US, at the embassy in Belgium when/if she lives with me, or back in South Africa. Knowing how long the process takes, my goal is to have this done ASAP so we can move back to the states together. If anyone has advice or suggestions I would greatly appreciate it.

Timeline

Filing the I 130 now should put you very close to the end of 2024, I would not delay. I assume she will interview in Belgium.

If you are US Military stationed overseas you may be able to apply for your wife's green card by direct consular filing through the US Embassy, thus completely eliminating the time consuming USCIS stage.  If that is the case it can be finished very quickly.

 

I would contact the US Embassy and ask if they will accept a direct consular filing.  Base legal services may be able to offer guidance as well.

  • April 30, 2021: NVC Received
  • May 01, 2021: Pay AOS and IV Bills
  • May 06, 2021: Submit AOS, Financial Docs and DS-260s
  • May 14, 2021: Submit Civil Docs for Stepdaughter
  • May 21, 2021: Submit Civil Docs for Wife
  • June 25, 2021: NVC review for Stepdaughter, RFE submit additional Doc
  • July 08, 2021: Wife Documentarily Qualified by NVC
  • August 31, 2021: Stepdaughter Documentarily Qualified by NVC
  • September 15, 2021: Received Interview Date from NVC, October 05, 2021
  • September 22, 2021: Passed physicals at Saint Luke's Extension Clinic
  • October 05, 2021: Interview at US Embassy Manila. Verbally approved by US Consul. Positive interview experience.
  • October 05, 2021: CEAC status changed to "Issued"
  • October 07, 2021: Passports tracking for delivery on 2GO Courier website
  • October 08, 2021: Passports with visas delivered.  "Visas on hand"
  • October 08, 2021: Paid Immigrant Fee
  • October 12, 2021: Temporary CFO Certificates Received
  • October 26, 2021 POE arrival at LAX
  • November 02, 2021 Social Security Cards arrive in mail
  • January 31, 2022: USCIS Status changed to "Card Is Being Produced"
  • February 04, 2022: USCIS Status changed to "Card Was Mailed To Me"
  • February 07, 2022: Green cards received.

Yes, if you already have orders to depart Belgium sooner than you could expect a visa for her using the normal channels, you can arrange to file directly with the Consular services attached to the US Embassy in Brussels.

Thank you all. I did some digging on the Brussels embassy website and I should be able to file directly with them under the blanket authorization for military members stationed overseas. I sent them an email with all the documentation and reasoning as their website states. Hopefully I'll hear back soon.
