Which way is faster k1 visa or IR visa?

Hello,

i am italian citizen and i live in Germany my boyfriend lives in LA and has US citizen. We want to marry and i want to join him in USA. As a European i have Etsa but i am mot sure if we are allowed to marry when i will be there. If we apply with Fiance Visa how long does it takes time? Which way faster Fiance or marrying and after joining?

I can tell you which is better, marrying first and then filing.

 

Currently they take about the same time.

Marry now and file I-130 for consular spouse visa processing.

 

You can visit him, or he can visit you while the I-130 is processing.

You can do the Utah online wedding and next time you are physically present together you can file the I130 to get the clock ticking.

You cannot arrive on ESTA with the intention to marry and stay (adjust status).   He can petition you for either a fiancé or spousal visa.   Each process takes around two years from start to finish.

its more important to understand the benefits of the spouse visa over the fiancee visa and the costs

spouse visa allows the immigrant to work upon arrival in US

easier to get SS #

easier to add to health care insurance

easier to get the Driving license

 

AND cost of the AOS process after marrying in USA is to go from $1225 to $2820

in long run spouse visa is cheaper

 

Most immigrants get bored and home sick when doing K1 and they can't DO ANYTHING like work or travel home to see family/ multiple posts here on these issues

To be fair, the OP did not mention coming to the US on WVP/ESTA and staying to adjust status.  It is perfectly legal to come on a visitor visa (B2/VWP), get married and leave for consular processing of a spousal visa.

It's even perfectly legal to come on a visitor visa, get married, and adjust status and stay. It's just not legal to arrive in the US intending to do that.

The benefits of each are worth considering:

 

K-1 
  More expensive than CR-1
  Requires Adjustment of Status after marriage (expensive and requires a lot of paperwork)
  Spouse can not leave the US until she/he receives approved Advance Parole (approx 6-8 months) 
  Spouse can not work until she/he receives EAD (approx 6-8 months) 
  Some people have had problems with driver licenses, Social Security cards, leases, bank account during this period 
  Spouse will not receive Green Card for many months after Adjustment of Status is filed.
  A K-1 might be a better choice when 18-21 year old children are immigrating also
  In some situations, marriage can affect certain Home country benefits, making a K-1 a better choice 
  A denied K-1 is sent back to USCIS to expire
  K-1 entrant cannot file for citizenship until after having Green Card for 3 years.


CR-1
  Less expensive than K-1 
  No Adjustment of Status(I-485, I-131, I-765) required. 
  Spouse can immediately travel outside the US 
  Spouse is authorized to work immediately upon arrival. 
  Spouse receives Social Security Card and Green Card within 2 or 3 weeks after entering the US 
  Opening a bank account, getting a driver's license, etc. are very easily accomplished with GC, SS card, and passport.
  Spouse has legal permanent Resident status IMMEDIATELY upon entry to US.
  The clock for citizenship filing starts immediately upon entry to the US.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..
