Adding Child After I-130

Hello everyone,

 

My wife and I are submitting are I-130 soon, but we are having a bit of a dilemma deciding when we should do it.

 

We would like to submit it as soon as possible because we will have to mail all of our documents from Poland and given some of the wait times on processing everying - the sooner the better. However, our third child is due to be born in mid-August. We also be going through the process of obtaining their US citizenship through the US embassy here.

We were wondering how easy it is to add a child to our application and whatnot after we have submit our I-130? We also will be going through the process of obtaining their US citizenship through the US embassy here. Is it a pain enough where we should wait until our child is born to send everything in? Or is it just a matter of submitting the necessary documents online or something? Because like I said, we would prefer to send everything in ASAP.

You should submit the I-130 online. No need to mail the packet to the US (it is expensive!).

You will be able to add the child to the DS260. You do not need to inform USCIS about the birth of the child while the I-130 is pending. 

Get the CRBA for the child after birth.

Is everyone from abroad able to submit online? When we contacted the embassy in Warsaw, they sent us a link saying that people from Poland should send documents to the Chicago lockbox.

We submitted the documents online and were approved with no issue. We were both living in Korea at the time. 

Filing online is easy and convenient.

Ah okay. Yeah, because this is actually the link the embassy sent us - https://pl.usembassy.gov/visas/family-immigration/how-to-apply/

And if you look at that link it doesn't say if residing in the US you can file online... correct? 

Some of the US embassy websites are outdated/do not have all the correct information.. 

You can file online or you can file by paper. Your choice.

That's a very good point. I guess our brains must've malfunctioned when we read that. Thank you!

I would file now and not waste precious time. You can update the info when your petition gets to NVC and you fill out a DS-260. There’s a section about children so you’d list the child there.

You can file on line if that is your wish.  If you "mail" the package, use DHL or FedEx, not the postal services.

There is no need to delay for the birth of a child who is not immigrating.  US Citizens NEVER immigrate to the USA.  You'll just update your information as needed at the NVC stage.

Facts are cheap...knowing how to use them is precious...
