My mom is a PR. She sponsors my brother for a PR. My brother is an Indonesian citizen who is in the US on a student visa. He received a message that they will be scheduling his interview in Indonesia. My brother requested that the interview will be done in the US. Now seems like the process is stalled. Everytime he asked about it, they replied to "not follow the instruction sent before since they were for immigrant visa processing", but he doesn't receive any instructions on his next steps. It has been about 6 months. Any ideas?

Did she file the I 485?

Visa interviews are never done in the US.

Senior Master Sergeant, US Air Force- Retired (after 20+ years)- Missile Systems Maintenance & Titan 2 ICBM Launch Crew Duty (200+ Alert tours)

Registered Nurse- Retired- I practiced in the areas of Labor & Delivery, Home Health, Adolescent Psych, & Adult Psych.

IT Professional- Retired- Web Site Design, Hardware Maintenance, Compound Pharmacy Software Trainer, On-site go live support, Database Manager, App Designer.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

34. I'm not sure about his priority date, I'll check. But he was already notified that he is being scheduled for an interview in Indonesia.

That does not mean his Priority Date is current and has he even applied to adjust?

It's the way I would proceed if his priority date is current.

Being scheduled doesn't mean anything if there isn't a visa number available for him, it just means he's in the queue for an interview. But he could still be waiting years yet if his PD isn't current.

he has not apply to adjust because he didn't get that specific instruction. Is that the way to go?

 

I'm checking with him what his Priority Date is.

If he is eligible to adjust and wants to adjust rather than doing consulate processing then it is up to him to file the paperwork

It's not their job to tell him to adjust or not.

I see your point but he also told them that he's interested to process the next steps here if possible instead of interview in Indonesia. I thought they would recommend a next step instead of keeping him waiting

Looks like that's i485. Will filing this be like a brand new application or a continuation of the same application? Would using i485 delay him a lot in getting the pr instead of just interview in Indonesia?
