Hello, 

 

I am USC and in the process of sponsoring my brother and his family. Currently they are in the US visiting me and will return to home country after 6 months of visit. As I have him in GC process, could his tourist visa be a problem if he visiting again in the future? Let me know if anyone has this same experience. Thank you!

AOS from J1 Visa

J1 Visa Waiver: I-612 based " No objection "

04/20/2012 : sent Docs to embassy in Washinton DC

05/15/2012 : NOA 1

06/08/2012 : NOA 2/ approval notice

I-130 / Spouse petition

04/16/2012 : File sent

04/22/2012 : received NOA 1 in mail

08/12/2012 : received NOA 2 / approval notice in mail

I-485 / Adjust of status

08/09/2012 : sent package(I-485,I-765,I-864) to chicago lockbox

08/16/2012 : received 2 text messages to confirm receipt the package

08/31/2012 : case status online changes says post office return my mail as undeliverable

09/04/2012 : case status online changes says uscis sent the documents

09/13/2012 : received NOA 1 of I-765 and Biometric Appt for 09/25/2012 at 10am, no NOA 1 for I-485

09/19/2012: walk in biometric done

09/28/2012: online notice for interview

10/13/2012: EAD approved

10/18/2012: EAD mailed

10/22/2012: EAD in hand

10/31/2012: interview canceled due to separated file not show up

12/05/2012: Interview at Casper office at 1pm, no decision

01/04/2013: received email and text about Approval

01/09/2013: card production ordered

01/10/2013: welcome letter arrived in the mail

01/14/2013: Card in the mail, woohoo

I-751 / ROC

09/15/2014: Sent packages out

09/18/2014: California office received the packages

09/22/2014: get the NOA receipt mail about 1 year extension

No.  It will be like 15 years or more until an immigrant visa is available.

 

The bigger issue is if they try to visit too much or "live" in the US on their B visas....they could be denied entry.

6 month family vacations are not very common, so I wouldn’t have them do that too often. How can they be away from their jobs for that long?

It is the very long visits that will cause a problem

One 6 month visit every few years should not be an issue.  Two or more 6 month visits with only a few weeks or couple months in-between will be an issue.
