Not sure if this is the right forum for this question. Asking for my friend, he is within the 90 day window to apply to get the conditions removed from his green card. He came here on a spouse visa and got a conditional green card. They are in the process of getting a divorce, but the divorce papers won’t be finalized by the time he needs to submit his papers to uscis.

Does he have to apply jointly with his wife? Or can he still file separately even though he doesn’t have divorce proof yet?

Divorce process is just getting started. Papers have not been served or anything yet. I’m not sure how long it will take, but he needs to apply to remove the conditions very soon because September 1 is the expiration for his green card.

he needs to look up divorce laws in his state / some states have a year waiting period before divorce is granted

he may need to consult a GOOD immigration attorney

and he should gather proofs he needs to show he entered the marriage in good faith
