Spouse/ marriage/ employment visa advice

Hi,
 

I'm needing some advice I'm on a J1 student visa. I'm wanting to marry my partner but he is sadly in prison so not sure if his criminal record would allow him to. And immigration lawyer told me I need to get hold of his criminal record so she can determine of he can or not. 

 

Just wanting to know as I can't afford 6k to pay an immagration lawyer for the process like she's asking.

 

Would it be possible as a fiancé to get a Visa or would I have a better chance at getting married? If so, how much would it cost and can anyone recommend me the easiest and quickest way to make this possible as it’s all very overwhelming

Fiancee visa is high risk for you because:

 

* warden has to approve marriage ceremony before you can file I-485

 

* With I-485, there can be an interview requiring his presence.

 

So the only option is IR-1 (not CR-1, because that requires I-751 and possibly an interview requiring his presence).

 

So if you want to DIY this, get married (if warden lets you), and he files I-130.

 

Maybe it gets approved. If so you move on to NVC and consular to get an IR-1 visa.

 

Your challenge is demonstrating bonafide relationship with an imprisoned spouse. Once you will not able to live with for decades.

It will not be easy, or quick, and I don't see a way out of paying a lawyer.

 

He will need a qualified joint sponsor.

 

Are you good with never being able to live with him?  

 

The process will cost thousands and thousands of dollars, and take many years, with no guarantee of a visa at the end.

This is not a DIY case by any means... Also, I wonder how one would be able to prove a bona fide marriage if you're never going to be able to live together?

 

Not saying that you have bad intentions, but (other) people who are desperate for a green card might look into finding a USC who is in prison for life. Benefit of (potentially) getting a green card without actually having to live with your spouse. that almost opens the door to some fraudulent cases.

 

You really need a lawyer to help with your case..
