What happens after "I751 - Petition to remove conditions of residence?"

Timeline

It's been a very long time since we received any updates on our status, but today we received a letter saying...

 

"Congratulations! USCIS approved your request to remove the conditions on your permanent resident status" You are deemed to be a lawful permanent resident of the United States as of the date of your original admission or adjustment of status. You should receive a new Permanent Resident Card (Form I-551, also known as a Green Card) within 60 days...."

 

Does this mean we can file for her citizenship now? The N-400? I'm asking because we didn't have a 2nd interview or anything... Just seems like a bunch of steps have been skipped. I remember filing and her having a biometric appointments over a year ago and that's the last thing I remember.

If you are still married to your USC spouse, it is 3 years from the issued date on your original 2-yr conditional GC, and you meet the other N400 criteria.  Then, yes, you are eligible.

Example:  If you got your 2-yr conditional GC with an issued date of October 15, 2019.  Then, you became eligible to file for citizenship N400 under the marriage-based 3-yr rule on July 15, 2022 (the window opens 90 days prior to apply) - even if you had a pending Removal of Conditions 751.

At this point, if you meet all the applicable criteria, and your 751 was already approved as well, you can move forward with the N400.

Also, yes, 751 normally do not have interviews unless A) you have red flags or a complicated case B) you have a combo interview because you filed an N400 while the 751 is pending.

September 2019 - AOS/EAD/AP filed

October 2019 - Biometrics Appointment

January 2020 - AOS RFE for birth certificate received and sent back

February 2020 - EAD/AP approved and got the card

October 2020 - EAD/AP renewal filed

November 2020 - EAD/AP renewal approved and got the card - AOS interview date issued

December 2020 - AOS interview, approved, and GC received

September 2022 - ROC filed
June 2024 - Biometrics Reused
July 2024 - Approved (NO INTERVIEW) and GC received.

According to your timeline, she was eligible to file for citizenship at the beginning of 2022 (generally a year after filing the I-751).

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

She was probably eligible to file for citizenship a while ago.  There is no requirement to wait for the i751 to be approved.

I would add that I-751 interviews are often waived if the beneficiary previously completed an interview with USCIS - for example, during the AOS process as would have happened with the OP of this thread.

 

By contrast, those who enter on a CR1 after having done only a consular interview will most likely have to complete an interview with USCIS during the ROC process (unless things have changed?).
