No recent taxes just pay stubs, need advice

Hello all! Firstly, thank you so much for your help in advance! I am looking for some advice please. 

 

Last year I was a full time nursing student and therefore unemployed. My income was zero and I didn't file taxes. 

 

Our case just got approved and sent to NVC but my first nursing job doesn't start for another 3 months, although, I do have an offer letter. 

In the interim - I am working as a preschool teacher over the summer until my nursing job starts. But, I just started working as a preschool teacher and should get my first pay stub soon. 

 

I am really worried about being rejected from NVC because of my lack of recent tax returns and becuase I newly got a job. 

 

Any idea how many pay stubs you think would be sufficient and if I stand a chance without tax returns? Do you think 3 pay stubs and my nursing offer letter would suffice?

 

I don't really have anyone to ask to joint sponsor me :( I'm really worried.

You can delay your case until you have income information to show. 
 

Have no income at all will not be good. Any savings that can be used? Check the requirements.

 

You will probably need a co-sponsor if your income is too low

Thank you for your reply. I have an income now; I just started a new job and it provides sufficient income to meet NVC requirements. Although, I recently started this job and should get my first pay stub soon. So my question was - how many stubs would be sufficient with my new job since I did not file taxes last year due to unemployment.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

Delay your case until you have filed your 2024 tax return if this concerns you.

The problem it isn’t the amount of paystubs,  you will need to present Tax Returns, só at least until next year. 
 

They request the last 3 years of Tax Returns. Because you will have just one (2023 when you fill out on 2024) you will need a co-sponsor l.

 

Be a Petitioner of a immigration is a big financial responsibility. You and the co-sponsor will be responsible for this person por 10 years (or until he/she became a US citizen or work a specific time). They want to make sure that your financial situation is stable enough so the beneficiary will not become a problem for the country.

This is not accurate. The only required return is the most recent tax year.

 

From the instructions:

 

You must provide either an Internal Revenue Service (IRS) transcript or a photocopy from your own records of your Federal individual income tax return for the most recent tax year. If you believe additional returns may help you to establish your ability to maintain sufficient income, you may submit transcripts or photocopies of your Federal individual income tax returns for the three most recent years.

 

It then goes on to say:

 

As stated previously, you must submit an IRS transcript or copy of your Federal individual income tax return for the most recent tax year...

 

and:

 

If you were not required to file a Federal income tax return under U.S. tax law because your income was too low, attach a typed or printed explanation. 

 

So a few points:

  • Submitting 3 years of tax returns is optional
  • Submitting the most recent tax return is required unless the individual was not required to file a tax return. 
  • If the individual was not required to file, they must include an explanation as to why (very easy in OP's case to explain this). 
  • For W-2 employees, current income is king, not income reflected on past tax returns.

@KseniyaG You have a few options here:

  1. Type up a written explanation as stated above regarding not filing taxes, and accrue paystubs at your current job to show current income. You technically only need 1 paystub, but I personally would be more comfortable with around 6. If you need to delay at NVC a bit to get enough paystubs, you can (as mentioned by others).
  2. Type the explanation as stated above but wait for your nursing job since it pays better, and delay at NVC until you have at least 3-6 paystubs.
  3. Delay at NVC and wait until you file 2024 taxes to avoid the "no recent tax return" issue altogether, and provide 6 paystubs for your nursing job. 
  4. Get a joint sponsor to alleviate any of the concerns pertaining to your income. You would still have to submit your own I-864 as the primary sponsor. 
     

If your current pay puts you even remotely close to the 125% threshold, I would go with option #2 or #3. Being over the guidelines isn't necessarily enough to guarantee that your I-864 will be acceptable, so better safe than sorry. Just mentioning that because you didn't state whether your new job is comfortable enough pay-wise to not be a concern. However, if that is not relevant then it really just depends on what option you are comfortable with.

My current teacher job is about 34k per year (seriously teachers need to be paid more), although I am hourly at $18/hr and not salary. No sure if that would be a safe option for NVC.. but this reply certainly gives me a lot to think about.
